The whole discussion is irrelevant because nobody really knows what the documents they claim were stolen by the FBI from Mara-lago contained.

The point should be that the NARA had knowledge of everything that was stored there and had personally reviewed them....so nobody was hiding anything from them.

It is not how government documents especially classified are stored. When you leave your government post, you do not get to take them with you. You can be prosecuted.

And the PRA is the sole statutory construct that deals with such issues involving a former POTUS. There is no criminal part of the PRA in dealing with papers a former POTUS has. The DoJ is attempting to involve another statute when PRA is the sole statute involved.

The PRA doesn't bother to repeat the criminal violations already spelled out in 18 USC, dealing with theft or misappropriation of government records and property.

The PRA doesn't have to re-invent the wheel or the law.

Just like a BATF regulations defines what is a destructive device, that regulation has no criminal part either.

Yep, Øbama had classified documents stored unsafely, as opposed to MAL which has 24/7 Secret Service protection. They never raided the Øbama warehouse where the classified documents were stored. They negotiated a settlement.

Actually it has never been verified that any of the millions of documents stored by the National Archives in Chicago were classified. The letter as I pointed out was typical legaleese, where they always hedge their bets. You will see in the indictments for the insurrection on January 6th, that say "on or about January 6th"

Technically the DOJ office of legal counsel, in determining that the president is exempt from indictment, pretty much says that the president isn't subject to prosecution (except by impeachment) while in office.

The problem with his argument, is that Trump ceased being president, and as Jeff Sessions said on the floor of the senate about Trumps impeachment trial, that Trump was subject to criminal and civil law that could be used as an alternate punishment to impeachment.
