Scathing Sotomayor dissent: "The President is now a king above the law"​


Justice Sonia Sotomayor did not hold back in her dissent.

“Let the President violate the law, let him exploit the trappings of his office for personal gain, let him use his official power for evil ends. Because if he knew that he may one day face liability for breaking the law, he might not be as bold and fearless as we would like him to be. That is the majority’s message today. Even if these nightmare scenarios never play out, and I pray they never do, the damage has been done. The relationship between the President and the people he serves has shifted irrevocably. In every use of official power, the President is now a king above the law.”

Presidential historian says today's decision makes it harder for Americans to "protect themselves"​

Presidential historian Tim Naftali said today’s decision would make it “much harder for the American people to protect themselves from a corrupt president.”
On Monday, the Supreme Court ruled Monday that Donald Trump may claim immunity from criminal prosecution for some of the actions he took in the waning days of his presidency.
Naftali said that the fact that a district court had to decide which elements of Trump’s presidency had immunity was “chilling.”
“The fact that the discussions with Vice President Pence have a presumption of immunity has to be determined by the district court though, has a chilling effect,” Naftali said
Go tell the J6 political prisoners.
 
I have to note the hypocrisy. The court over ruled RvW because they said no such protection exists in the Constitution.

Now they rule a president has certain protections despite there being nothing about that in the Constitution.
If they ruled solely on the document Trump would have total immunity without first being impeached and removed, as that is the only reference in the Constitution. Nor does that reference differentiate between official and unofficial acts. Nobody should really be happy with this half assed compromise.

I don't disagree it's a half assed compromise which isn't the courts job. They are to rule, not compromise.

She is right. It's a deplorable decision from a corrupt court.
 
This insanity should be tested properly. President Biden could officially order the justice department to designate Trump an enemy of the country and then order the military to eliminate that threat. And maybe while they are at it also take out the conservative members of the supreme court. All very officially of course.

Yep, I agree with this. No president should be held in check for OFFICIAL acts…the question now will be “was J6 an official act?”

Also, this ruling also means that there will be leniency against Biden in the future
 
Per the majority decision, it was o k for trump to pressure pence to violate his duties and the law, because they were discussing the duties of pence's office.

Good grief..you’d think for being a Supreme Court justice, she wouldn’t be so melodramatic..

Presidents have always been immune for official acts…this doesn’t clear the way for a president to assassinate their political opponent.

No in the least.

Trump acting to further his campaign is not an "official act" per any reasonable person.

Trump failing to surrender classified documents when ordered to do was by a federal court after he left office and conspiring to evade the subpoena and retain the documents after he left office are not official acts because he wasn't President.
