Criminalizing Free Speech

You know he is not being charged because of what he said, he is being charged for his actions that incited his supporters whom enter the capitol building and cause damage.

Its funny that republicans were blaming BLM for the vandalism that occurred. Yet when trump tells his supports to stop the steal and vandalism happens then it is all about free speech.

Free speech is not breaking the law, it's the actions that follow that determines if laws are broken.

That why the free speech defense is a desperate attempt to divert attention from the actions of committing a crime to free speech. He is being charged with inciting a riot and the results of said riot.

If they had peacefully stood outside the building and shouted "" Hey , Hey Trumps are man, if he can't do it no one can" then that would be it. No crime.

Instead they broke into the building and vandalized it and try to stop an official government function.

Trump took a oath to uphold the constitution and the laws of the US. Peaceful demonstration is not breaking the law.

what law is being broken is Conspiracy (overturn the election) to defraud the government and there are probably some civil rights violations. ,

Obstruction - he tried to stop Biden's certification of winning the election. Laws specifically say how that is suppose to be done.

Corruptly obstructing, influencing, or impeding an official proceeding is a felony under U.S. federal law. That is what he is being charged with.
 
The DOJ is attempting to make free speech a criminal offense. This is unheard of in America.

The right to free speech is neither absolute nor unlimited; speech advocating for criminal acts is not entitled to First Amendment protections.

Trump violated the law when he instructed Pence to refuse to certify the EC votes.
