From August 2015 to December 2017, the Defendant orchestrated a scheme with others to influence the 2016 presidential election by identifying and purchasing negative information about him to suppress its publication and benefit the Defendant’s electoral prospects.

In order to execute the unlawful scheme, the participants violated election laws and made and caused false entries in the business records of various entities in New York. (“AMI”), a media company that owned and published magazines and supermarket tabloids including the National Enquirer, admitted in a non-prosecution agreement that it made a payment to a source of a story to ensure that the source “did not publicize damaging allegations” about the Defendant “before the 2016 presidential election and thereby influence that election.”

There is no "underlying crime" to charge Trump with in the indictment, Trump is being charged with Falsifying Business Records in the First Degree, the connection to other crimes that others committed which is the "aiding and concealing" part of Section 175.10 it talked about in the Statement of Facts document also submitted to the court with the documents. It isn't that Trump must be charged with this "underlying" crime committed by someone else. During trial the prosecution will have to show the connection for "aiding and concealing" the other crime to justify the felony level charge.

The problem is that some people think we are at the trial stage where the prosecution has to layout it's entire case. We aren't we are at the indictment/arraignment stage where the results of the Grand Jury (indictment) are presented to the court and the individual charged (arraignment). After this the prosecution will have to turn over all evidence (testimony, statements, texts, phone records, travel documents, audio records, invoices, checks, account ledgers, etc.) to the defense as part of discovery. What the prosecution is not required to do is to layout their entire case strategy to the defense.

The defense will then have to opportunity to go through the evidence, compare them to the Indictment and Statement of Facts and submit motions to the court. Motion to Dismiss, Motion to Suppress Evidentiary Item XXX, ect. The prosecution gets to respond and then the Judge makes a ruling on each individual motion.

Ok, but as part of the arraignment, doesn’t the entire charge need to be presented? Including all underlying reasons? I’m not saying Bragg has to detail strategy, but he needs to allow the accused to know exactly what it is they are being charged with and why.

Now, some would point to the SOF and say “there are the reasons”, but bragg didn’t say that, and even a lot of media are saying it’s unclear what the underlying crime is.

The accused has a right to know the charges against him, from the outset, not later during discovery, that’s when you present evidence and such, but the allegations need to be known up front, in detail. You can’t just bring a partial charge at the arraignment and say “we’ll let you know the underlying crime we are charging you with at a later time”.

It was, the connection to election law and campaign violations as the basis for First Degree (felony) Business Record Falsification instead of Second Degree (misdemeanor) were file with the court of the same time. So say that the defendant has not been informed of the basis of the first degree enhancement isn't true. He has been. The particulars of the DA's legal theory on how that justifies the enhancement is strategy that will be part of later proceedings.


The accused has a right to know the charges against him, from the outset, not later during discovery, that’s when you present evidence and such, but the allegations need to be known up front, in detail. You can’t just bring a partial charge at the arraignment and say “we’ll let you know the underlying crime we are charging you with at a later time”.

The accused does know the charges against him 34 counts of Falsification of Business Records in the First Degree (Class E Felony).

Remember this is the indictment stage based on a Grand Jury of his peers voting to indict. This is not the trial stage were evidence all evidence has to be laid out by the DA.

Some people want trial level details, but that won't happen yet.

So, they are saying the hush money payment was a campaign contribution, which exceeds the normal limit, that’s where they get the violation. Daniels not talking about the affair was a benefit to the campaign, and the payment for that benefit was excessive for normal contribution limits.

But as you said, that’s a federal law violation, but trump paying cohen and listing it as legal expenses is a New York accounting law violation, but because that violation was done to conceal a federal campaign finance violation, it makes the incorrect entries in the ledger an attempt to defraud by concealing their true nature as payments to reimburse for a federal crime, which makes those ledger entries a felony.

Which is true under New York State Penal Code Section 175.05 Falsification of Business Records in the Second Degree.

However any lawyer familiar with New York law will also know that New York State Penal Code Section 175.10 Falsification of Business Records in the First Degree is a felony when the falsification is performed to aid and conceal another crime.

In kind contributions (such as paying $130K dollars out of your own pocket) to aid the campaign is a violation of campaign finance laws. Even when AFTER the election the money was repaid.
