BOTH are crimes and harmful, but 1 is worse than the other... also he sexually molested her and even sexually abused her due to the age difference....but neither is the same as raping her....if there was no penetration of any kind... if she had willingly said yes, and they bumped uglies, due to her age and their age difference, he raped her...statutory rape.
