Because the bar to actually incarcerate someone over mental illness or competency is actually quite high. You don't just get to report someone and have them institutionalized, even if they saw they are hearing voices.Stupid enough to identify, incarcerate, and hear his plans of shooting people and then LET HIM GO!! The YELLOW FLAG law says a RELATIVE can turn you over to the police, to hold on to them until they get a mental evaluation and the mental professional evaluating this person under the yellow flag law, can put in a request to take the guns away temporarily, until a judge can give the person due process.The yellow flag law states that a medical professional can use a court order to have guns removed. So if he had guns they should have been removed and he shouldn't have been able to purchase gun afterwards.
So, two guys get into an argument at a football game and one yells at the other one "I am going to fucking kill you", they should be jailed for that to make sure they do not follow though?

BUT HE WAS NOT TURNED IN BY A RELATIVE using the YELLOW FLAG LAW.....?
he checked himself in for help, he committed himself....to get help, not for an evaluation of whether he could have a gun legally or not?
You would think the mental heath person would have tried to get his guns removed, even though the yellow flag law did not apply....
but that may not be the law in Maine and it may be a very hard task for a mental health professional to succeed at doing?
