The vast majority of the USA does not use NY laws at all on what Trump was charged with

Do you see now it is a Supreme Court case? When some states prosecute for things most others do not, it is time for the Supreme Court to do it's thing.

Gambling and Casino’s are legal in some states. Does it mean that it must be legal in all states?

States Rights means each state can and does decide on its own laws within the framework of the US Constitution.

For years now I’ve been saying. You need to learn the laws of the area you are in. Every state has different laws. They are all written differently.

Some states have degrees of murder. In Georgia we have Murder. Period. No degrees. One charge fits all. About the only variation is Felony Murder. That means it was in the process of committing another crime. That’s about it.

When the McMichaels were on trial, we heard endlessly about how they should have been charged with second degree or even manslaughter. We don’t have those in Georgia. We have Murder, Voluntary and Involuntary Homicide. That’s it.

Trump ran his businesses in New York. He didn’t have to. But he decided to run them there. It is up to him to comply with the laws.

This demonstrates a real problem that I’ve commented on regarding Trump before. Lawyers.

In politics, lawyers are there to keep you from getting into trouble. Their job is to keep you from breaking the law.

Trump has always operated with the idea that Lawyers were there to get him out of trouble after the fact. That plan has the potential of disastrous results.

I wonder what you would say were 9 states to create laws saying Jim Crow laws are legal and prosecuted those who did not follow that law?
Trump was not proscuted for real laws to begin with. One law used was ended by law. Then that expired law was used. How can that be?

We have had problems due to the Democrats passion for ruling our lives. They have no laws against a thing and suddenly decide it is time to make the nothing against the law. 41 states do not agree with NY laws which is a hint that 9 states do it wrong. As is this case.

Ok. Go back and read my reply again, or for the first time if my guess is right. It clearly states that each State can create its own laws within the framework of the US Constitution.

That means Texas can’t pass laws prohibiting some religions, and New York can’t pass laws banning all guns. Within the framework of the Constitution. Go ahead. Read it again.

Now that is covered. Maybe.

You guys have got to start reading news from other sources besides Twitter. The law allows the misdemeanors to be prosecuted as Felonies in specific circumstances. The jury, which included two lawyers, felt that this qualified.

I was listening to the news as I drove home from work. A legal professor was saying that a mistake the Trump Defense Team made was that they did not offer a narrative for the case.

I said that a couple days ago. Drawing the examples of successful defenses in court to team Trump. The narrative explains the evidence in such a way that the Reasonable Doubt is created. You might have heard about that thing. It’s kind of important in criminal trials.

It is what one of my favorite examples the OJ trial did. They started with a narrative. Someone else did the crime and the cops were pinning it on OJ because it was easy.

The three most damning pieces of evidence was the Bruno Magli (sp) shoes, the glove, and the DNA. First they attacked the cop who found the evidence and caught him in a lie on the stand. Then they questioned the claim it was OJ’s gloves or shoes. For DNA the prosecution bored the jury to zombie like states with the technical, and the defense asked a few questions. Like one in five million chance. Oh so you are saying that in the Los Angeles Basin, statistically speaking, there are twenty people with the same DNA profile as OJ?

Then the glove didn’t fit.

A narrative the defense in the Jim Williams murder trial worked well in Savannah.

The Trump defense was all the witnesses are awful for testifying against Trump. That doesn’t create a narrative. It is a school yard reaction if a kid loses a popularity poll.

What it means in New York then he was not the only one from the accusations. The stock exchanges should leave. They will not at this point because they are under the umbrella of the globalists including the Federal Reserve.

I guess CONVICTED FELON Trump should have investigated whether paying off the hooker you were banging while your wife had a new baby, so that the story wouldn't leak to the voters and then falsifying records to make it tax deductible, was illegal before he did it yes?

Maybe you should think twice before voting for someone so dumb.

I have commented as you did that they must be within the framework of the US constitution. That sizes up the NY law failure nicely.

I won't ramble on about other instances. The essential guts as you say is within the framework of the Constitution. Sorry to have to repeat a point we each made already.

No it isn’t. It is your contention that since only 9 states have that law it is wrong for the law to exist. That’s nonsense.

These were not new laws. They’ve been on the books for decades. You guys are always told. Learn the laws of the area you are in. Just because it’s legal to turn right on red at home doesn’t mean it’s legal everywhere.

For years Virginia had a law prohibiting the use of Radar Detectors. I don’t know if they still do. But should we tell Virginia that since nobody else has that law they aren’t allowed to? Do we need a constitutional convention to pass any law at the state level?

What is the threshold for approval? 26 states for a simple majority? Two thirds majority?

Prostitution is legal in Nevada. Do we tell them to knock it off?

In California condoms must be worn by porn actors. Do we tell them that is silly since no one else has that law?

States Rights mean each State can govern as the people wish, within the framework of the US Constitution. If you don’t like those laws, don’t go there.

So are you telling me that prostitution must be legal? If not, why mention it?
When I learned what the NY law being used actually is, it looks like a law from hell.
It has no basis to use it even in NY. I believe that the Judge shoved his lever on this trial because he hates Trump.

Let me try to do this right. I believe the Supreme Court can and will deal with this. Trump in the end will be judged not guilty.

Ok. Grounds for appeal. I’ve asked this question before, and nobody has answered. What flaws existed? What precedent was ignored? What Civil Right was trampled? Or was it just unfair?

He also tampered with the jury and my money is on juror intimidation. Time will tell.

If the Judge hated Trump half as much as you all claim, he would have tossed Trump in jail for violating the Gag order. He could have, and it is not unheard of, sentenced Trump on the spot after the Guilty Verdict. He didn’t.

When you get away from the RW propaganda you see that most legal experts are thinking the Judge was fair. The RW Propaganda paints the Judge as a slobbering Trump hater.

As far as things being legal, that is the States. Some States have legalized Marijuana. That is their business. Not mine. I don’t get to say how people in other states govern themselves.

The law in New York was written to eliminate the personal expenses from the corporate books. A vacation with your secretary isn’t a business expense.

The law was expressly written to stop people from writing off personal expenses as business expenses.

Maybe the Judge realized how you think and face facts, you are against Trump. Not for violating Idaho law, or Florida Law or 39 other state laws, but for the law created by NY state.

Are we having a meaningful conversation or one you have no thought of changing your mind and in fact same for me. In words, are we wasting the time for each of us?

What weight do you place on the Judges family being huge fans of Biden and kick him a lot of money to support Biden?

I want to summarize pretty fast my state of mind.
Justice in the USA luckily has the Supreme Court available. Presidents have important jobs and the Supreme Court as I see them will happily be involved.

I have a hunch they will come out on Trump's side. Do you disagree in concept?

Reuters reports this? Note the sex did not happen in NY but in Nevada. I say Nevada based on the fact that in CA prostitution is prosecuted and Stormy has not been prosecuted by CA. Nevada accepts prostitution.

On appeal, Trump's lawyers will likely argue that Daniels' testimony about their encounter in a Lake Tahoe hotel room went into too much detail for a case that hinged on whether Trump falsified documents rather than on whether he had sex with Daniels.23 hours ago

I voted for Trump in 2016. I could list the reasons, but I doubt they will be believed. I abstained from voting in 2020. I said then, and many times since, both candidates were steaming piles of shit and I would not pretend one wasn’t to give my vote to that one.

I still think Biden is a steaming pile of shit. I would love to vote against him. But sadly, the candidate is the one person left who is actually worse.

Why is it that only Democratic Party donors are biased to the point of unprofessional behavior? Alito showed a lot of bias towards Trump with the flags. No screams that he is biased and can’t behave professionally. Cannon was appointed by Trump and has had every ruling that was appealed overturned. No howls of outrage from the Right that she is unfairly biased.

Why is it only the left is so corrupt in your opinion?

As for the Supremes. They have, this far, only ruled in favor of Trump once. That was the Colorado Ballot case. The claim of Presidential Immunity being all encompassing was tossed. As were all the others. So guessing how they would rule, and it would be merely a guess, is pointless. I prefer to discuss the merits and the precedents.

Look it up. I said the NY case was the weakest of those Trump is facing.

I keep hearing it will be overturned but I never hear a rational reason. No claims that it violated the sixth Amendment. No pointing out that the Judge broke with precedent.

The excuses I’ve heard have been laughable. It wasn’t fair because Trump is too well known. Ok. When will he be less well known to answer the charges in court? Or is any trial impossible because of his notoriety? Does that apply to anyone well known? Any famous person? Or just Trump?

Well this opened up matters. If you voted for Trump So did I. I happened to not like stuff he said a lot of the time. To me it was him harming Trump. When he harms himself, he must accept that blame. I feel Trump erred even in this case by walking outside as if the media would like him. They hate his guts for the majority of them. They are left wingers and we all know that is fact. I voted for Trump in 2020 but preferred my vote be cast for say Mike Pence. I prefer Ron DeSantis currently.

My claim has nothing to do with popularity. IT has to do with how that NY law was applied. It took a case from Nevada and transposed it to NY state and decided it had to do with elections. But the law was not used against the prostitute the media persists is a star and landed on Trump. Then to compound it they alleged it was election interference by Trump. Trump was the candidate. Biden must be on guard unless he also be hit for election interference.

Ok. The jurisdiction came up from Trump’s choice to base the DJT trust in New York. The trust was a business. And as such is subject to the NY laws.

This case, like every other, is Trump screwing it up all by himself. I agree with you there.

The reasons I turned against Trump had to do mostly is that he never understood the job of President. He imagined it as the greatest CEO job in the world. It isn’t.

The conspiracy took place outside of New York, so they didn’t have jurisdiction of those crimes. That’s the Constitution. Crimes must be tried in the county the event took place in. The DJT Trust was in Manhattan. That is the City, County, and State of New York. The false entries took place there.

As for the cases, I said New York was the weakest. I think the strongest is the Documents case. I think Georgia is a close second.

There again, Atlanta has jurisdiction as the participants who did this were in Atlanta when it happened. The Governor and Secretary of State were in their offices in Atlanta when they talked to Trump on the phone.

One of my often stated opinions is that people need to learn what the laws actually say and mean. And they need to understand their home laws don’t follow them when they travel. This is mostly posted in cases of shootings. Gun and self defense laws vary greatly from State to State.

These laws were created to stop people from abusing the business write off tax deductions. I’ve posted at least a dozen times that the New York courts would have been powerless if Trump had paid from his personal accounts instead of the business. He could have listed it as miscellaneous and taken the tax hit.

But here again, one of my peeves with Trump. He doesn’t understand what lawyers are really for. They can get you out of trouble. They work a lot better by preventing you from getting into trouble in the first place.

Would you say this trial was just? I get the impression you do. But based on our discussion of the actual law of NY, it is tied to election laws. We have not posted the election laws. We posted the business records law.
I studied law in college. So for me law is more easily handled. A lot of papers say show me the candidate and I will find you a crime. Biden will have his day in court. This case opened the dam.
