Both are rather blatantly unconstitutional.

I have no idea how civil forfeiture has survived this long. Any competent, honest judge, hearing any case in which such a forfeiture is challenged, should have thrown the whole concept out a long time ago as a blatant violation of the Fifth Amendment.
