That's not the issue – Federal law does not require a background check with regard to private face to face gun sales between residents of the same that take place in that state. A convicted felon can obtain a firearm in such a private sale with the intent of committing a crime where the seller has no idea he's selling a gun to a felon.

A prohibited person may not be able to 'legally' obtain a firearm, but there's nothing in the law preventing him from in fact doing so when buying from a private seller.
