So Where Does the 1st Amendment End?

People can say whatever the hell they want to.
Yes they can, but if people have the right to respond to whatever they hear the way that they choose to respond to whatever they hear, is saying whatever you want to really a smart move to make? In other words, maybe the best thing to do is remain quiet until you are willing to deal with whatever takes place after you put out there whatever is on your mind.

God bless you always!!!

People yes, government no.

Kids did not break any law. And if they're not breaking the law, what they do in their free time, it's of nobody's concern, especially not concern of the government, or a school.

Government have no right to respond to your free speech. There is no law against being a jerk, racists, or simply stupid.
This could be debatable. Back when I was still in high school, a girl in my class wasn't calling who she was talking to any bad names, but what she did choose to say in the presence of the teacher is what got her sent to the principal's office as well as the threatening delivery of her word choice. She had her head down on her desk and when the boy next to her placed his hand on her to wake her up, she got mad and said what she put out there for the whole class to hear, so in other words, it isn't just about what is said. How something is said is what makes a world of difference.

God bless you always!!!

Smart has nothing to do with the unalienable right to free speech. And it's certainly not governments place to judge ANY speech that is merely offensive. That's what free speech is. It may very well be painful or offensive.

^^^ If what a person chooses to say goes against rules that other people have the right to put in place where their place of business is concerned, like the girl that I mention in my previous message in this chat for example, that right there is when things can get interesting.

God bless you always!!!

Holly

P.S. I don't remember how much farther things went where that girl was concerned. The only other thing that I remember is that she did leave the classroom after the teacher told her to go to the principal's office, but I do not know if she actually went and if she did, I don't know if she was issued any kind of punishment for her choice of words and how she decided to say them.

What does a school denying graduations have to do with the First Amendment?
First Amendments let's people say what they want.

Let's highlight the key noun there for the slow kids.

Glad you support the DMV revoking your license for that hateful post.
I do not represent the DMV. Those students represent & reflect on the schiool.

Apple and oranges. This is public school. It's not school's job to police kids when they're not in school.
Misbehaving in school, and not following school rules is one thing. What kids are doing, or saying, outside of school is not their business.

Students don't represent the school, they attend it.

Should we fire every teacher who is promoting socialism, or badmouthing the president?

No, but because of what their feelings can lead up to later on, some form of restraint/separation may be needed.

Yelling fire in a crowded theater endangers people.

What about saying something people don’t like? Can the government punish you for speech made in your home and gets put on the Internet that is not violent, but racist?

One school district thinks it can.
Remember- the schools are closed until at best next September.

Wish I had a nickel for every stupid thing a teen said in the past year.

What does a school denying graduations have to do with the First Amendment?
Why are they denied a graduation?
Answer: for words spoken.
Not the sharpest pencil in the cup, are you?

Guess I'll just post it again -- What does a school denying graduations have to do with the First Amendment?

You need a hint on this?

The language thereof:
"Congress shall make no Law...."

I've just word-searched the entire Constitution. "High Schools shall make no Law" was not found.

Here, horse. This is called "water".

Because a PUBLIC school is a government institution, brainlet. Do you need this in crayon?

Oh really.

So Carrollton High School was chartered by Congress, was it?

The fact STILL is, nobody, neither the high school nor Congress, prevented these kids from posting the video. If they had, NO ONE WOULD KNOW ABOUT IT. :banghead:

The video EXISTS. Therefore no entity "prevented" it. Simple law of existence.

What the fuck are you babbling about?

The school is a government institution that took punitive action against students outside of their purview. That is a flagrant 1st Amendment violation.

The school has a responsibility to maintain a safe environment where all pupils can study free from violence and hatred. Having racists in the community is a direct assault on that. The school did the only thing it could do.

A school is a community and racism has no place in any civilised society.

The video was made in a private home, moron. The school has ZERO authority to do anything about it. Just watch the inevitable lawsuit. Dumb shits like you just made these kids millionaires.

IN *WHAT FUCKING WAY* were these kids "PREVENTED" from posting the video? How do you KNOW about it if it wasn't posted? How does the school know about it?

Hm?

As far as what action they can take AFTER the fact, aside from the safety and security of its own student body, think of the "morals clause" that got whoever it was, those Duck guys with child wives, fired from their TV show. Think Carrollton High School actually WANTS to have a rep for racism?

It's not school business to monitor and judge what kids do outside of the school. That's not school purpose, but to educate them. If kids didn't break any laws, it's not school responsibility to find them "guilty" of anything, and to punish them for it. We have a legal system for that.

Monitoring social media, arresting people who mispronounce the gender, or sending police to the door for posting a picture with the butter knife on the Facebook, might be "normal" for you British faggots, but it's not normal for us, because we do have constitutional rights in this country. Personally, I am against school districts doing this kind of thing- but schools have much greater leeway with underage students and certainly this is not the first time that a school has expelled a student for doing things outside of school that go against school policy.
