Wrong. I live in Illinois so all the EC votes will go to Biden no matter who I vote for. I could vote for Trump in this state and it would have the same impact as voting for Popeye the sailor man.
 
The law states that only willful retention is illegal. How are you going to prove he knowingly took them and retained them?

He probably wont be prosecuted for it for the same reason Pence wasn’t prosecuted. Proving willful retention is too difficult.
It will be easy for you to prove that by citing the actual case law. Question however is do you really have proof? Even you admit how difficult it is to prosecute Trump and win.
