PALM BEACH, Fla. (AP) — Donald Trump says he received a $17 million insurance payment in 2005 for hurricane damage to Mar-a-Lago, his private club in Palm Beach. But The Associated Press has found little evidence of such large-scale damage.

Two years after a series of storms, the real estate tycoon said he didn’t know how much had been spent on repairs, but acknowledged he pocketed some of the money. He transferred funds into his personal accounts, saying that under the terms of his policy “you didn’t have to reinvest it.”

“Landscaping, roofing, walls, painting, leaks, artwork in the — you know, the great tapestries, tiles, Spanish tiles, the beach, the erosion,” he said of the storm damage. “It’s still not what it was.”

Trump’s description of extensive damage does not match the versions of Mar-a-Lago members and even Trump loyalists. In an interview about Mar-a-Lago’s history, Trump’s longtime former butler, Anthony Senecal, recalled no catastrophic damage. He said Hurricane Wilma, the last of a string of storms which barreled through in 2004 and 2005, flattened trees behind the estate, but the house itself only lost some roof tiles.

Just over two weeks after Wilma, Trump hosted 370 guests at Mar-a-Lago for the wedding of his son Donald Jr. Wedding photographs by Getty Images showed the house, pools, cabanas and landscaping seemingly in good repair.

Palm Beach building department records showed no permits for construction on that scale after the storms. The only permits that appeared hurricane-related were $3,000 in repairs to storm-damaged outdoor lighting and the vacuuming of sand from the property’s beachfront pool. Likewise, records of the city’s Landmarks and Preservation Commission reflected no repair work conducted following the 2004 and 2005 hurricane seasons.

So, how did Trump pull that off?

A state court ordered President Trump to pay about $2 million to an array of charities to resolve one of the lawsuits brought against him by the state of New York.

Justice Saliann Scarpulla of the New York Supreme Court, New York County Commercial Division signed off on a resolution between the parties after the state’s attorney general accused the president of misusing the Trump Foundation in connection to his 2016 presidential campaign, specifically in connection to a charity event he held for veterans during the Iowa caucuses.

Trump University (also known as the Trump Wealth Institute and Trump Entrepreneur Initiative LLC) was an American company that ran a real estate training program from 2005 until 2010.
It was owned and operated by The Trump Organization. A separate organization, Trump Institute, was licensed by Trump University but not owned by The Trump Organization.
In 2011, amid multiple investigations, lawsuits and student complaints, it ceased operations.
It was founded by Donald Trump and his associates, Michael Sexton and Jonathan Spitalny, in 2004. The company offered courses in real estate, asset management, entrepreneurship, and wealth creation.

Trump has an option. Accept that the valuations were way lower (in multiples) and he signed off on them. This would make him civilly liable for damages of misreporting his wealth...

Trump could fight it and state that valuations are right and he was just following that valuations from Cushman and Wakefield. James has little case to answer except some of the glaring factual errors... But the IRS has an open and shut case, Trump put in his estimated values around the same time into the IRS, they can massage a little but Trump was in multiples.. Game Over, this baby is chess..

So I say Trump's lawyers saw this and are hoping that pleading the 5th a few hundred times and then hoping the burden of proof is proven by NY State. But they changed over to a civil case and lowered the burden of proof considerably...

James’ office interviewed more than 65 witnesses and reviewed millions of documents part of the investigation, the lawsuit said.

The Manhattan district attorney’s office has been conducting a criminal investigation of Trump and his company that mirrors in many ways the allegations made by James in her lawsuit.

What bank filed fraud charges?

She's going the civil route because she doesn't have the evidence to prove any crimes. If there are no criminal charges of fraud and no conviction of criminal fraud how can any penalties for fraud be levied by the state ?

Happens all the time.

State law allows a broad range of civil remedies against companies committing commercial fraud, including revoking licenses to conduct business in the state, removing company officers and forcing the payment of restitution or disgorgement of ill-gotten gains.
