You forget that if Dominion sues, then the burden of proof is on Dominion, and they won't be able to prove a thing. Their software not only is bound to have bugs, but the fact secret software could have been down loaded at run time, makes their product indefensible.

That theory of subject to tampering would mean you could pick any car, and claim it's a death trap, because any garage, dealership, or hacker could turn the car lethal.

I don't think dominion or smartmatic would risk suing Trump. It might give him the opportunity to present evidence of fraud that has been suppressed and kept from being evaluated by courts. It may be a can of worms.

Just the opposite. If Trump has some top secret information about dominion, as a private citizen he could be thrown in jail for revealing it. And the first relevant question dominion would ask in deposition is "where did you get your "facts" from?"

Trump would have to tell them why he made that claim, and what proof he had of it. And if he cites people on TV, who have since retracted, he stands alone.
