That's exactly what they did. The statute of limitations does not prevent them from proving he violated 175.05.

Nope. Nowhere does it say that the misdemeanor has to be charged. It's a silly little trick your playing, attempting to exploit a loophole which would magically reduce the statute of a limitations of a felony down to 2 years when it should be 5.
