Really?
Why don't you link to this "law?"
I'm not you as I said YOURE a waste of oxygenSo?
Stop wasting oxygen.
And?
Speaking of simple, since Congress never made any laws on this to whom does enforcement fall? (Think 10th)
So you agree Texas can put up razor wire at its border.I thought you said the courts did that?
Perhaps you could show us your SCOTUS creds?
FOAD, look it up. You should have done that before launching your ignorant thread
Cool opinion bro, Section 5 of the 14th clearly states that nothing in the amendment is self executing, all portions require acts from congress. And I think that's exactly what the supreme court will determine.
Section 5 Enforcement
The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.
.
So, you're saying that the 14th Amendment would require Congressional legislation to bar each and every of the thousands of Confederates that had previously taken an oath and participated in the Confederate insurrection, right?
Thousands of pieces of legislation?
Guess again, fool!
Nope, just one law, do they have to pass new legislation to get taxes from every tax payer? But since you seem to be ignorant, confederates were given amnesty and later pardoned.
This is the latest revision of that law:

18 U.S. Code § 2383 - Rebellion or insurrection
www.law.cornell.edu
BTW that's a criminal law and requires a conviction.
.
States rights as you said. Are there immigration laws?
Then no. It's illegal
Are there transportation laws?
The no, it interferes with navigation.
Yes it does. As a matter of fact the 14th amendment was created to restrict states not give them authority.14th doesn't say Congress need do anything except overturn the ban by a 2/3 vote.
Absent passing laws, which hasn't been done, and voting to reverse a ban, what exactly are the duties of Congress in the Section 3 of the 14th?Yes it does. As a matter of fact the 14th amendment was created to restrict states not give them authority.
They already passed a law - The 14th Amendment. It's quite clear - anyone that engages in insurrection that has previously taken an oath is barred from holding office. No further law is needed.
The 14th does not require a criminal conviction. It is a civil action, not a criminal action. It only requires 'preponderance of evidence'.
The authors of the 14th did not expect that thousands of confederates would have to be convicted before they were barred from office, anymore then they required any further legislation.
