Actually that rule making the 60 votes needed, was when the republicans changed the filibuster rule. A senator used to have to take the floor, remember Mr. Smith goes to Washington, for the duration. Now just by declaring the desire to filibuster the bill is stalled without having to take and hold the floor, so the senate can proceed with other business.
