Military makes little effort to punish deserters


There is no crack team of bounty hunters, no elite military unit whose job is to track them down and bring them in.

Despite a rise in desertions from the Army as the Iraq war drags on into a fifth year, the U.S. military does almost nothing to find those who flee and rarely prosecutes those it gets its hands on.

An Associated Press examination of Pentagon figures shows that 174 troops were court-martialed by the Army last year for desertion — a figure that amounts to just 5 percent of the 3,301 soldiers who deserted in fiscal year 2006. The figures are about 1 percent or less for the Navy and the Marines, according to data obtained by the AP under the Freedom of Information Act.

Some deserters are simply allowed to return to their units, while the majority are discharged in non-criminal proceedings on less-than-honorable terms.

I really didn’t expect him to get jail time but that dishonorable discharge is going haunt and follow him for the rest of his life. Prison time comes to an end that dishonorable never will.

Why? Do you think he is going to get a job with the government? Some liberal will have him working within a week. Remember Chelsea Manning being offered the gig at Harvard?

“The decision on Sergeant Bergdahl is a complete and total disgrace to our Country and to our Military,” Trump tweeted.

A change from "resolved on its face". He now deemed a military Judge unfit.

This isnt about Trump it's about a coward that deserted, good men died and were wounded looking for his dumb ass and now he gets a slap on the wrist

Rinckey and other military officials say the Bergdahl case will be difficult. It's now in the hands of Gen. Mark Milley, head of U.S. Army Forces Command at Fort Bragg, N.C.

Even if Milley concludes Bergdahl deserted his post, he may consider mitigating circumstances while weighing whether to charge the soldier with desertion or being absent without leave (AWOL). He may also handle the matter administratively.

Milley has broad discretion, Army spokesman Wayne Hall said. Beyond court martial, possible actions include counseling, a reprimand, forfeiture of pay, reduction in rank or involuntary separation from the military.

Bergdahl could receive an honorable, general or other than honorable discharge. That decision can determine whether he gets as much as $300,000 in back pay and other benefits, including continued health care.

There was psych testimony, and Trump commenting in the recent past did not help the Prosecution:

Dr. Charles Morgan, a forensic psychiatrist and professor at the University of New Haven and Yale University, testified Wednesday that Bergdahl suffers from numerous mental illnesses, including schizotypal personality disorder and post-traumatic stress disorder, as well as social anxiety/phobia and cognitive deficits.
Symptoms of schizotypal personality disorder include brief psychotic episodes that "are not as frequent, prolonged or intense as in schizophrenia," according to the Mayo Clinic.
Morgan said he interviewed Bergdahl's friends and family and did extensive testing on Bergdahl, including psychiatric evaluations, stress exams and neurological psychological testing. Based on the results, Morgan said Bergdahl was suffering from schizotypal personality disorder and PTSD before he enlisted in the armed forces, adding he "falls clearly into the profile" of someone who had schizotypal personality disorder by the time he enlisted.

I agree, an easy sentence, IF he can retain mental capacity; Danny Rolling was allowed to plea, and be executed, AFTER he was on psych meds.

Good, but they should have deprived him of his ability to breathe.

Only one soldier was executed for desertion in WWII
No soldiers who deserted in Korea or Vietnam were executed

What did Bergdahl do to warrant execution while thousands of others who deserted in Iraq and Afghanistan were merely discharged?

Berghdal also provided valuable intelligence about the Taliban when he returned. He had close up knowledge of their organization and tactics
