Of course it does. And at noon on the 3rd, until they swear in the newly elected Senators, Democrats will hold a majority, 34-30. During that brief period, they could pull the trigger on the nuclear option so the Republicans can't filibuster and confirm Garland.

Or Obama could appoint Garland during those few minutes as a recess appointment.

Will either of those happen? Probably not. But I wouldn't count my chickens until the 4th if I were a Republican.

And what make you this k they can't filibuster? They have much more than 1/3 of the Senate even in your scenario
Until they swear in the 34 elected Senators, which admittedly doesn't take long, there will be only 66 Senators, a majority of whom are Democrat & Independent. Eliminating filibusters on Supreme Court nominees requires only 24 hours notice according to Senate rules. If Democrats pull that, a simple majority of the 66 Senators in Congress can confirm Garland.

And it's hardly illegal.

I agree with you on this....It is really dumb to change math into something it isn't.
 
Since we are going to interpret the laws and constitution in any way that suits our purpose at the moment then why not let the people's (and not the courts) opinion of what those laws mean actually be the meaning of those laws. It just seems way more democratic to do it that way instead of letting politicians and a non-elected judiciary to decide what the constitution means. That is the most frustrating thing about court decisions. The people who are affected by those 'interpretations' have no real power over the decision making process.
I don't think I fully understand your point here. We are NOT going to interpret the laws in any way that suits us. If Trump does as he promised, there should be at least one, maybe two Originalists appointed to the SCOTUS.

It would be bad form to allow the uneducated left to determine what a law means, regardless of how much they like to say they are educated.

And the US has gone beyond the point of no return, it's war, right wing presidents will use their presidency to try and win the war, and the left wing presidents do the same thing. It's about as healthy as smoking 1,000 cigarettes at the same time.
 
Well Trump has the chance to appoint over two hundred federal judges and who knows how many on the Supreme Court.

The appointee's will all be conservative.

Republicans still control the Senate.

I always thought that the SCOTUS would take challenges to law, measure that challenge against the COTUS and then decide if the law was in conformity with the law. But with their ruling on ACA and Gay marriage the SCOTUS is an extention of the legislative branch, only the SCOTUS can make law at the whim of the 9 old men and women.

In my opinion, that is why Trump won. We need a reformed judicial system that actually stays with the requirements of the COTUS. The republic was saved on Nov 8th.
