If that were the case Judge Sullivan would have sentenced Flynn a year ago. Sullivan although a strict Judge is also a logical and even handed Judge realizing the extenuating circumstances and the foul odor of a frame up. That is why he has refused to pass sentence and allowed this evidence to be presented.
