Chief Justice John Roberts Sides With Liberal Justices 5-4: Allows Border Patrol to Remove Razor Wire Installed By Texas at Border

As I said previously, Article IV section 4.
4. The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence

And that is up to the Supreme Court to uphold? It doesn't forfeit the right to the states.

The Supreme Court cannot repel an invasion. It isn't a right. It is an obligation of authority. If the federal government abandons its duty, by default that obligation falls to the states.

The Constitution clearly grants border enforcement to the Federal government, not state government. So much for strict Constitutionalist actually being that.
Trouble with that is the fed has ignored the law.

Except the Feds AREN'T enforcing the border.

You seem good at making up things. There is no default. The Constitution clearly states it's up to the Federal government. But here again, I bet you've complained about the courts just creating things that clearly aren't there.

Duh........

Texas told the justices that there was no need for them to get involved in the dispute because the court of appeals has fast-tracked the case and is scheduled to hear oral argument on Feb. 7. But in any event, Texas dismissed the underlying premise of the Biden administration’s argument – that Border Patrol agents are carrying out their responsibilities under federal law when they move or cut the wire – as “false.” To the contrary, Texas contended, as the federal district court in this case found, Border Patrol agents are not actually apprehending or processing migrants who cross through holes in the wire that the agents create. And more broadly, Texas concluded, the public interest favors not only respecting the state’s property rights, but also supporting efforts to combat the influx of “deadly fentanyl,” human trafficking, and “minimize the risks to people, both U.S. citizens and migrants, of drowning while making perilous journeys to and through illegal points of entry.”

It is up to the Federal government. When the federal government abdicates?...

Conservative Justices are often challenged by the constitution, not that they always get it right. But they often split from what would be seen as what a hack justice on the right would do.

Leftist judges are activists who always vote lock step with leftist ideology. They have a greater good in mind, to change the country to something else overall

In order to offset the leftist influx of blatantly partisan judges, conservatives should probably put activist judges in too. If only one side tries to put fair judges in out of good faith and the other doesn’t.. over time the honorable side will get drowned out

The governor won't be arrested. By the time it comes to that this temporary order will have expired and the issue will be in litigation.
