There are no States that completely ban abortion. Many have imposed time limits. Others have pending legislation to challenge these limited abortion laws. The States are working it out and it's going fine.

Because that is the way the laws are drawn up. There is a separation of State and Federal power as, hopefully, was taught in school. Hopefully they didn't stop teaching this. I am not arguing for or against abortion, just on the law and how State and Fed are separated. This is the United States of America, and it was designed this way.

Separation of state and federal power has nothing to do with the question as asked regarding your statement expressing as some sort of fact that abortion is up to the states as designed. Designed by whom or what statute since the right for a person to terminate her own pregnancy is not addressed in the Constitution. It can therefore be considered by individuals who become pregnant to be an unenumerated right falling under the human rights principle of right to privacy and right to bodily autonomy and protection against government intrusion on one’s lawful pursuit of life liberty and happiness.

There is no reason or right for any state to decide to restrict the liberty of women when they cause no harm to civil order or any person when they choose to safely terminate their own pregnancy through a safe medical procedure.

Abortion laws are not laid out in the Constitution or in laws on the books in colonial America. The best way to settle it is to go back to common law that was in effect during the framing of the Constitution when one desires to be a true originalist.

During the late 18th century, abortion was not a safe medical procedure but when a woman or her husband wanted it to happen the women took care of it. There was an unofficial contingent of midwives that came together whenever a woman was pregnant and did not want to be.

In every town, village and city It was not considered a crime, essentially prior to viability, in a condition referred to back then as quickening. After quickening, it was considered a misdemeanor mostly to prevent midwives from harming their patient by unsafe practices after the fetus become too far along.
