Supreme Court just sent it back to the lower courts.

Yep, the supremes punted it down to the lower courts.

Waiting on the "plain english" description over at SCOTUSBLOG, but what it appears happened is the court is looking for plans that actually show they increase diversity, instead of just making diveristy a goal and not observing any implied affects.
 
Why did they agree to take the case if they were just going to punt?

Refusing to take the case would have let the lower court ruling stand. What SCOTUS did was send it back with a note saying "think about this for awhile".

The judgment of the Court of Appeals is vacated, and the case is remanded for further proceedings consistent with this opinion.

Where does the Constitution mention diversity? I must have missed it. Please advise.
 
The John Roberts effect again. Wonder what Obama has on him? We know what they had on David Petraeus and why Petraeus kept his mouth shut when the Susan Rice Benghazi Talking Points went down.

Obama is the guy who had two of his opponents supposedly sealed messy divorce proceedings unsealed to win two of his elections. He now has every phone call John Roberts ever made and to what number. Why would you think this scumbag wouldn't now not use this treasure trove of info to further his agenda? J. Edgar Hoover looks like a Boy Scout in comparison.

Anytime a person gets a public benefit based upon their race, it is a violation of the idea that "All Men are created equal".
