Is Braggs stretching it with a felony?

I saw their explanations and they upheld the letter of the campaign LAWs, unlike the democrats who never explain their partisan votes.
False. Their explanations didn’t mention the law. They said that prosecuting Cohen was good enough and that they had other things to do.

They never attempted to proclaim anyone’s innocence. In fact, they tacitly admitted that the NDA was illegal since they noted that the prosecution of Cohen adequately addressed the issue.

Stop what? You really don't know what you're talking about. You're basing your position on what you read on Wikipedia. :eusa_doh:

And based on your ignorance, you're making absurd claims; like how 4 votes were needed to pass. This is really what you wrote...

So the vote to "take further action" failed 2-4. (it needed 2 more votes to pass)

I don't know if you got that from Wikipedia or if you just made it up, but it's wrong.

I showed you 2 members did not vote. So for it to pass required at least 3 of the 4 voting members, a majority, to pass.

Four members of the Commission shall constitute a quorum...

Savvy?

At least four out of the six commissioners needed to vote in order to have a quorum. Not all six. So it was not a 2-4 vote. It was a 2-2 vote, just as I said. The 2 voting Republicans blocked it.

There is a difference between a quorum to have a meeting and a majority of the voting members to take action.

You will have to look a little deeper. Does a majority of for action mean a majority of only those present representing a quorum, or does it mean a majority of all sitting commissioners (present or not). There is a difference and different entities handle it differently.

OMG. How can you not understand what you posted?
1. A "quorum" of the FEC means that there are at least 4 members present. If four or more members are present, then they can vote legally, with a majority being 3-1, 3-2, 4-2, or higher majorities.

2. If all 6 members are present, as opposed to voting, the majority needed for passage would be 4 members. You seem to be missing that 3-3 votes fail. Whether a commissioner abstains or doesn't cast a vote THAT IS NOT AN AFFIRMATIVE VOTE. So out of the 6 person quorum 4 affirmative votes not having been cast, the item FAILS to pass. Don't confuse a quorum with a legal majority of affirmative votes.

3. Your assertion that 4 present members need to vote to constitute a quorum is in error. From your post "If less that four members of the Commission are present at any time during a meeting..."

4. My meme was supposed to be a joke, that we're "beating a dead horse". Let the beating continue...

It's called an "In Kind Contribution" and is legal, as long as the reported to/and by the campaign on their filings with the FEC.

When actions are taken to benefit a campaign they have to be reported to/and by the campaign and cannot exceed the limit of $2,700. Therefore the $130,000 Cohen paid to keep the porn start from telling her story (again) in the media was paid to prevent negative information about the candidate being broadcast over the airwaves, cable, and internet.

It was one of the crimes Cohen was convicted of in Federal court.

Early on yes. He was still trying to adhire to the coverup. But once presented with the evidence that the United States Attorney General had for charging and he knew that the scheme couldn't be buried anymore he voluntarily turned over evidence.

We know that Cohen recorded phone conversations. One was released concerning Trumps involvement with the Karen McDougal hidden payments, you think that Cohen only ever recorded 1 phone call to cover his ass? Cohen was Trumps fixer, and the recording shows Cohen likes to have insurance. I think it is highly probably that additional taped calls involving Daniels have been turned over the the Prosecution.

This is a pretty sleazy character, this Cohen guy! Lies to Congress, lies to a grand jury, violates repeatedly Attorney-Client privilege and now lying once more.

Please continue to believe that the entire case will be based solely on Cohen's testimony.

Which is what I posted to you. And not for nothin', but; that 2-2 tie to determine any of the parties violated campaign finance law, was 4 votes. Blocked by Republicans to protect Trump.

1. There were 6 commissioners present
2. There were two partisan "aye" votes with no basis in campaign LAW
3. There were two "no" votes to uphold the LAW
4. There was one "abstention", which is not an "aye" vote
5. There was one "not voting", again not an "aye" vote

So from the SIX members present, there were only TWO "yes" votes by democrat HACKS. 2 - 4.

All that's required is a majority vote among those voting. A no vote is neither nay nor aye.

WRONG.
There were 6 present so 4-aye votes were required to pass.

The recorded votes were
2-aye
2-nay
1-abstain
1-NV
The motion did not pass

To jag your wire one more time:
if the abstain changed to aye, would the motion pass 3-2?

I say no, since there were 6 present a 3-2 vote would still fail.

1. Was Cohen convicted in a trial or did he make a plea deal? He got nailed for tax evasion, not Federal campaign violations.
2. What Cohen did or didn't do has zero to do with Trump.
I think it would be really hard to convince a jury that Cohen paid over $300,000 in hush money just before the election to hide Trumps illicit affairs with no promise of repayment.

Trump went to great effort to hide it all by paying back Cohen in monthly payments disguised as legal fees months after the election.

Cohen created the NDA and set up a bank account in a phony name owned by a shell corporation in order to disguise the hush money payment.

Dispite Cohens efforts the Feds uncovered the ruse. Cohen was charged with two election law violations, lying in setting up the bank account in a phony name that issued the hush money money payment, and a number of IRS violation.

Apparently Bragg has proof that Cohen was operating as Trump’s agent making Trump guilty of a criminal conspiracy. I think that the criminal conspiracy will be the underlying crime that will make the falsified records a felony.
