Trumps 34 "Felonies", but this is not Lawfare

Those were misdemeanors.
They became felonies only because they covered up another crime.
So what was the crime that was covered up by the legal NDA payments to Stormy?
HINT: There was no other crime. The felonies are bullshit.
The jurors felt they were in service of another crime and the legal statute doesn't say they have to agree on which one or that he had to be convicted of that other crime.

Yes

An illegal (unreported) campaign contribution that was laundered through his attorney's (Michael Cohen) bank account.

Now, how long are you all going to keep asking this same dumb question even after it has been answered for you?

THERE WAS NO OTHER CRIME.

THE 6TH AMENDMENT SAYS THAT DUE PROCESS IS REQUIRED, THERE ARE NO "FELT LIKE A CRIME" CRIMES.

COLORADO TRIED TO HANG AN "INSURRECTION" CRIME ON TRUMP TO KEEP HIM OFF THE BALLOT. THAT WAS OVERTURNED.

The FEC said that there was no crime. That is FEDERAL campaign LAWS.
Citizens United said that Trump can do whatever he wants with his own money.

NY is NOT authorized to consider FEDERAL CRIMES

What is stupid is Bragg's "Lawfare" indictment and Merchan's bullshit conviction. The bullshit convictions will be overturned.

The crime was 34 counts of falsifying business records. That's absolutely a crime. What raises it from a misdemeanor to a felony is the jury believing the intent was to cover up another crime. Intent gets weighed towards the seriousness of your charge in many other areas of the criminal justice system. This isn't anything new it's just you're not used to thinking about it in terms of white collar crime.

You can tap-dance around the facts of the case as far as what are state crimes and what are Federal Crimes.
The jury had no right to consider a FEDERAL statute as a crime. Judge Merchan should have given legal "jury instructions".
His instructions were that jurors didn't need to agree on the same crime, which was not listed in the Bill of Particulars as required. That violates the Law.

Nope. Falsifying business records is a crime in the State of New York.

Who gives a shit what it says in the Bill of Particulars? The judge was explaining how their decision applies to the statute Trump was charged with violating.

His sentences in all counts will run concurrently. Now if the Judge decides to run them consecutively then you could call it Lawfare I suppose.
What was the underlying felony?

Dems running a government: you have to pass the Bill to see what’s in it

Dems running a courtroom: you have to convict Trump to learn the charges

Falsifying business records is a misdemeanor. What crime covered up by payments to Stormy made those a felony?
Read the "Instructions" below to see how illegal those felony convictions.

The Judge
It is not just the appearance of a conflict with Judge Merchan but a record of highly biased decisions.

The charges
Bragg decided to use an unprecedented criminal theory not only to zap a dead misdemeanor into life (after the expiration of the statute of limitation) but to allow him to try violations of not only federal election law but also federal taxation violations.

The Evidence
The prosecutors then proceeded to expressly state that it was “a fact” that federal election violations occurred in this case and that Trump ordered those violations

The Instructions
Merchan allowed the jury to find that the secondary offense was any of the three vaguely defined options. Even on the jury form, they did not have to specify which of the crimes were found. Under Merchan’s instruction, the jury could have split 4-4-4 on what occurred in the case. They could have seen a conspiracy to conceal a federal election violation, falsification of business records or taxation violations. We will never know. Worse yet, Trump will never know.

Falsifying business records in the second degree is a misdemeanor, in the first degree it's a felony and the statute itself says nothing about them having to agree what the other crime is, only that they have to believe the intent was to cover up another crime.

Kangaroo court. There was no other crime. We'll see after the appeals are over.

All of your pissing and moaning here is not going to make him "un-guilty."
For the time being and for the foreseeable future he is a felon.
IF down the road sometime some appellate court overturns one or more of his felony counts on this one it isn't going to matter much because he'll probably have felony convictions from the other cases against him.

Biden will "probably" lose the election anyway, so Trump's felonies don't matter.
