They are not illegal once they get processed. They are not even undocumented. Processing includes a scheduling of an immigration hearing in a federal immigration legal process. That gives the immigrant the legal right to be in the USA until such a hearing determines otherwise. The immigrant is given a document stating that they are awaiting a hearing, hence, they are documented and legal.
