Liberty Counsel, as part of the National Coalition to End Judicial Filibusters, recently signed a letter urging the the U.S. Senate leadership "to end the judicial filibusters at the earliest possible moment and well before a Supreme Court vacancy should occur." The letter also pointed out that "while it is the right of the President to expect the Senate to give Advice and Consent within a reasonable period of time, it is the duty of every Senator to offer Advice and Consent through an honest, up or down vote."

A number of Republican senators still remain opposed or undecided on the issue. We have compiled a list you can use to call the Senators and ask them to end the judicial filibusters.

Filibuster was a quaint Senate custom requiring holding the floor of the Senate nonstop.
Then it evolved to where you didn't have to actually talk, you just had to declare a filibuster
Then it evolved to where EVERY bill and appointment required 60 votes
It has now evolved to where you only need 51 votes for appointments
We need to evolve once again to end filibuster forever

Democrats got their break in May when Vermont senator James Jeffords left the Republican party. That switched control of the Senate to the Democrats, who immediately turned their attention to the eleven appellate court nominees then before the Senate Judiciary Committee, two of them Democrats — a gesture from Bush. Those two were immediately confirmed. The rest would not even get hearings. Instead, Democrats began calling for “litmus tests” — explicit demands that nominees state their views on everything from abortion to affirmative action to Congress’s unquestioned power to regulate anything and everything.

But the near lock-down on appellate-court nominations did not end with the 2002 midterm elections, which switched control of the Senate back to the Republicans. It was then that Senate Democrats began the unprecedented filibustering of appellate-court nominations. The most egregious case was that of Miguel Estrada, whose life story was pure American dream. First nominated by President Bush in May 2001, Estrada finally withdrew his name from further consideration some 27 months later, after seven failed cloture votes in the next, 108th Congress.

Things came to a head early in the 109th Congress when Republicans themselves, still in control of the Senate, threatened finally to “go nuclear” — to end the appellate-court filibusters Democrats had introduced only in the previous Congress. That was headed off when the bipartisan “Gang of 14” reached a compromise: Democrats would filibuster nominees only in “extraordinary circumstances,” they agreed, and Republicans would not use the nuclear option. That compromise held for the rest of the 109th Congress — though not without difficulties — but it became moot after Democrats regained control of the Senate following the 2006 midterm elections since they no longer needed to filibuster Bush nominees.

and you need to separate judges from legislation. one thing at a time.
 
I could get behind this myself, Reid should have called his own gang of 14, worked out the 51 vote rule then decided on an implementation date- something fair, close enough to see, yet far enough to plan for, with a third of the senate up for reelection every cycle, a date like 2018, would be a good point, 2/3s of the senate seats would have been reelected or elected, so Jan of 2019 with that new Congress being seated, the rule would change .

In addition,right now, the gop would allow fully one half of the present nominees and half thru 15 to move forward under a temp. 51 vote rule.

Remembering the fact the rules change for the senate says you need 67 votes, I would have sppted this anyway as its imho, fair to both sides.


Instead Reid ( and the dems) got to eat his/their cake by blocking gop nominees thru 02, filibustered 2004-07, blocked bush nominees in 07 and 08 and now, gets to change it so he can get appointed who he likes.

Thats not fair and , its not 'moderate'.

Filibuster has gotten out of hand and 60 votes should not be required for the Senate to do business. The Senate is gridlocked and nothing can be accomplished. The filibuster is to blame

The Chairman of the Senate Judiciary Committee plays a big part in these nominations. He past activities have been to hold up the nomination is both senators from that state do not support the nominee. It is unlikely he will change that unofficial rule.
