Israel Palestine International Law Symposium: Is Israel an Apartheid State?

(COMMENT)

The two principle weapon in the terrorist arsenal of the Islamic Resistance Movement (HAMAS) and their fellow terrorist entities (Jihadists, Fedayeen Activists, Hostile Insurgents, Radicalized Islamic Followers, and Asymmetric Resistance Fighters) is raising the visibility of making a religious connection in the struggle and politicizing the international issue in their favor. While there are many examples of such - none is more divisive than those associated with the State of Israel versus the Islamic Terrorist.

The great effort behind the Islamic Resistance (et al) is the work they put into persuading public opinion that they are not the Islamic terrorists with the objective of influencing political and legal decisions on an unprecedented scale. And there are many countries in the world where this is working very well. It has even influence both the International Court of Justice (ICJ) and the International Criminal Court (ICC). The ICJ and ICC are very afraid to point out to the public the weaknesses in the accusations of Genocide,
Crimes Against Humanity, War Crimes, and Crime of Aggression. And to a further extent, the current effort by the combined assets of the Hostile Arab Palestinians (HoAP) is trying to overturn Article 51 of the UN Charter (insisting that Israel has no right to self-defense against the Islamic Resistance terrorists). And that would have ramifications across the globe.

Most anti-Israeli and pro-Palestinian that spout this Cololialism accusation that claims that Israel is some sort of Colonial Power over the Palestinians is pure dribble. The anti-Israeli and pro-Palestinian bandwagon sling these terms around as if they know what they are talking about; with nothing further from the truth. It is all part of a deceptive propaganda effort to discredit Israel in the Court of Public Opinion. The anti-Israeli and pro-Palestinian bandwagon (an appeal to the masses, to alter the reality in the Court of Public Opinion → or an appeal to common belief fallacy) is strictly a propaganda effort.
The proper terminology that the C-24 Committee uses in its annual review of Non-Self-Governing Territories (NSGT).
The Truth of this is found in the official UN explanation by the
Special Committee on Decolonization (C-24).

A/RES/1514 (XV). Declaration on the granting of independence to colonial countries and peoples
A/RES/1654 (XVI) Is the C-24 Mandate that examines the application of the Declaration on the Granting of Independence to Colonial Countries [AKA: A/RES/1514(XV)]

Be careful as to what you might consider reasonable and/or true republished and rebranded entries passed on by our friend P F Tinmore; as he has done here. Our friend Tinmore quite frequently repeats incorrect or misleading information and sometimes deliberately misleading information.

There are only four Colonial Powers in the world (
Israel is NOT one of them). They are The United Kingdom, The United States, France, and New Zealand as last reviewed by C-24 last month (May 2024). AND all 72 NSGTs are listed by the C-24 on their official website AND none are in the Middle East and North African (MENA) Region of the world. That means that the C-24 does not recognize any of the disputed Arab Palestinian Territories as under colonial rule.

You can verify this at the official UN C-24 Link.
As is often stated, to remind people, that not everything on the internet and in cyberspace is accurate. This is especially true about many of the propaganda entries made with an axe to grind. You can pick on Israel all you want. But do your homework and talk intelligently on the subject matter. Know when to speak up and know when to listen.
One of the earmarks of suspicious information is when they do not cite official sources or spout some (
like colonialism) without knowing the definitions of the words they use.

Considering that the activities of Israel, in particular the denial to the Palestinian people of their right to self-determination and independence, constitute a serious and increasing threat to international peace and security,

Indignant at the continued violations of the human rights of the peoples still under colonial and foreign domination and alien subjugation, the continuation of the illegal occupation of Namibia and South Africa’s attempts to dismember its territory the perpetuation of the racist minority régime in southern Africa and the denial to the Palestinian people of their inalienable national rights,

3. Reaffirms the inalienable right of the peoples of Namibia, of the Palestinian people and of all peoples under alien and colonial domination to self-determination, national independence, territorial integrity, national unity and sovereignty without external interference;

The Israelis do not disagree with this. ALL people have the Right to Self-Determination and Independence. NOT just the Palestinians. The Jewish people had the Right to Self-Determination when they establish the Jewish State of Israel.

The serious threat is from the Arab Palestinians.

From the Islamic Resistance General Principle and Policies:

◈ The Islamic Resistance Movement “Hamas” is a Palestinian Islamic national liberation and resistance movement. Its goal is to liberate Palestine and confront the Zionist project. Its frame of reference is Islam, which determines its principles, objectives and means.
◈ Palestine, which extends from the River Jordan in the east to the Mediterranean in the west and from Ras Al-Naqurah in the north to Umm Al-Rashrash in the south, is an integral territorial unit.
◈ Palestine is an Arab Islamic land.

◈ Resisting the occupation with all means and methods is a legitimate right guaranteed by divine laws and by international norms and laws. At the heart of these lies armed resistance, which is regarded as the strategic choice for protecting the principles and the rights of the Palestinian people.

Well, --- There is a reason that such decrees in the form of General Assembly Resolutions are not law, not treaty, and/or not binding. It is because the can, as in this case, be contradictory to International Law, and or express a principle or policy that goes beyond the approved "Declaration on Principles of International Law concerning Friendly Relations and Co-operation among States" or that which is expressed within the Charter of the United Nations.

The surprise attack on 7 October 23, likes the tens of thousand of rockets, mortars, or other penetrations of Israeli Sovereign Territory (like that which precipitated an Armed Response by Israel → since before the turn of the century) falls well beyond that which is covered by binding law or Treaty.

If you want to call an Armed Article 51 Response against a lawless and rogue Islamic Resistance that wants to stretch the sovereign territory of Israel, that is you perogative.

(COMMENT)

The Hostile Arab Palestinians have no right to interfere with that already established through their Right of Self-Determination and Independence.

If the Hostile Arab Palestinians believe that they have a legitimate grievance, that has not been addressed and answered by the Principle Allied Powers through time and now, then there are peaceful means to settle the dispute. But as it stands, Israel is established and exists under the umbrella of the Montevideo Convention on the Rights and Duties of States. And it is defending itself under the Charter of the United Nations against violent actors in an asymmetrical confrontation, in order to achieve political or religious goals.

IF you wish to make the argument that there is some "external interference" THEN the position can be taken that Israel is under siege by externals forces to unravel its establishment independence under the Right of Self-Determination free from the influences of the Jihadists, Fedayeen Activists, Hostile Insurgents, Radicalized Islamic Followers, and Asymmetric Resistance Fighters originating from the Arab world and unrestrained by the incapable Arab League.

(EPILOGUE)

The Arab Leaders (indirectly) benefit from the fact that all the principle designated Arab Palestinian Terrorists are focused on the Israel venue and not creating havoc in the adjacent sovereign nations. Thus they have an interest in allowing the Low Intensity Conflict (Israeli • Palestinian) to continue (maybe) indefinitely as long as the containment does not adversely effect their domestic general population.

This explanation that suggests that some nation called "Palestine" had "international borders" is as bogus as a three dollar bill.

The Government of Palestine was established by the British as a matter of international protocol. While the Arab Palestinians were invited to participate in the government, they declined. Whatever their reason, no landscape anywhere in the Levant had been under Arab Palestinian governmental participation.

Currently, the international boundaries for the West Bank (Treaty Volume 2042, 1-35325)
and Gaza Strip (Treaty # No. 17813) are documented by treaty. The actual control of the Gaza Strip today is undefined after the unilateral disengagement of the Israelis in 2005. However, there is no question that the general population and the Islamic Resistance have abused there control and demonstrated that the3y can not fulfill thier portion of the UN Security Council Resolution 242 (1967).

On the withdrawal, the all claims or state of belligerency were NOT terminated. The exchange of cross border hostile fire in after the 2005 disengagement from the Arab Palestinians did not stop. From that point on, every Israel military action was a response to some Hostile Arab Palestinian violence.

※→ P F Tinmore, et al,

I skipped over nothing. The meat of the claims you make come from A/RES/42/95, a non-binding feel good resolution out of the General Assembly. It does no change the reality that the Islamic Resistance illegally uses violence to prey on the sympathy of donor nations to maintain financial contribution so the criminals can further to further ideological goals. It does not change the reality that the State of Israel has established, defined, and defended borders. The Islamic Resistance committed criminal acts against the sovereign State of Israel. No matter what you preach, that does not change.

You quoted my post then skipped over it.
(COMMENT)

A bunch of babble about the terrorist supporting content in non-binding resolution is simply unanswerable.

Let us make this very clear: You either support terrorism and the actors that use violence in an effort to raise visibility for a cause that is not their own, or you support a peaceful resolution and negotiated settlement over grievances. There is no middle ground.

IF you support the Islamic Resistance and endorse further violence to push political and religious objectives - THEN you support terrorism. It is one of those decisions that is either black or white.

You should just start every posting you send with the preface: I support the cause and objective of the designated terrorists.
Article 1 said:
Do not try to put your "by any means necessary" cosmetics on your pig. You will not find it "any means" clause in any binding Resolution, Convention, Protocols, or Resolution to established laws. For the last quarter century, the Islamic Resistance and the other associated Jihadists, Fedayeen Activists, Hostile Insurgents, Radicalized Islamic Followers, and Asymmetric Resistance Fighters originating from the Arab world and who rekindle the Israel-Palestinian conflict, for whatever reason, is a flawed criminal conspiracy.
UN Special Coordinator for the Middle East Peace Process (25 APR 22) said:
Let me be clear: there is no justification for acts of terrorism or violence against civilians. Violence, provocations, and incitement must stop immediately and be unequivocally condemned by all”
