yep, but the Constitution states that principal officers have to be appointed....those if that Special Counsel is investigating AND prosecuting, like a US Attorney, they have to followthe appointments clause.

The Attorney General may appoint officials—
(1) to detect and prosecute crimes against the United States;

Grounds for appointing a Special Counsel.
The Attorney General, or in cases in which the Attorney General is recused, the Acting Attorney General, will appoint a Special Counsel when he or she determines that criminal investigation of a person or matter is warranted and—
(a) That investigation or prosecution of that person or matter by a United States Attorney's Office or litigating Division of the Department of Justice would present a conflict of interest for the Department or other extraordinary circumstances; and
(b) That under the circumstances, it would be in the public interest to appoint an outside Special Counsel to assume responsibility for the matter.

There have been close to 50 such Counsels appointed over the years and every motion to dismiss for this reason has been rejected until today. I have no doubt this will be appealed and no doubt it will be overturned.

SUBCHAPTER II—OFFICE OF SPECIAL COUNSEL​

§1211. Establishment​

(a) There is established the Office of Special Counsel, which shall be headed by the Special Counsel. The Office shall have an official seal which shall be judicially noticed. The Office shall have its principal office in the District of Columbia and shall have field offices in other appropriate locations.

(b) The Special Counsel shall be appointed by the President, by and with the advice and consent of the Senate, for a term of 5 years. The Special Counsel may continue to serve beyond the expiration of the term until a successor is appointed and has qualified, except that the Special Counsel may not continue to serve for more than one year after the date on which the term of the Special Counsel would otherwise expire under this subsection. The Special Counsel shall be an attorney who, by demonstrated ability, background, training, or experience, is especially qualified to carry out the functions of the position.
