And why would you presume that the expert witness would not have used evidence - which would be the law itself concerning elections.

Because it's not relevent. If Trump's lawyers wanted to argue the absurd notion that a payment to a porn star was not an election contribution (which, by the way, is laughable because that is exactly what Cohen was put in prison for by Trump's DOJ) then they could have made that argument in their closing statements.

Instead, they argued that Trump never had sex with Stormy and that Cohen paid her all on his own despite 34 documents saying otherwise.

The expert witness was an expert on federal election law. How could he know whether Trump reported the hush money payments to the FEC? He was not on the FEC board at that time and was not privy to the Trump's FEC reporting's. This is why the judge would not allow him to testify as expert witness in regard to Trump's FEC reporting. The Defense could have him testify as an expert witness on FEC reporting, just not Trump's reporting. The Defense opted not to call him as a witness.

He would have testified that hush money payments are not a violation of the federal election laws, and that he didn’t have to report them.

This is SUCH a nothing case.
