I have to guess that 99% on this board will agree that the conclusion of the following case is a miscarriage of justice.





1. "Texas Says It's OK to Shoot an Escort If She Won't Have Sex With You

2. A jury in Bexar County, Texas just acquitted Ezekiel Gilbert of charges that he murdered a 23-year-old Craigslist escort—agreeing that because he was attempting to retrieve the $150 he'd paid to Lenora Ivie Frago, who wouldn't have sex with him, his actions were justified.

3. ...she accepted $150 from Gilbert and left his home without having sex with him. Frago, who was paralyzed by the shooting, died several months later.

4. Gilbert's defense argued that the shooting wasn't meant to kill,...

5. ...actions were justified, because he believed that sex was included as part of the fee.



6. Texas law allows people "to use deadly force to recover property during a nighttime theft."



7. ... "not guilty" verdict ...."

Does this remind anyone else of the Dred Scott decision?

Actually, the first thing this reminded me of was a decision from years ago when a man shot a repo guy taking his car but wasn't convicted. That was also in Texas.

Murder is murder, and always against the law. The jury in Texas somehow determined that shooting (I suppose) and unarmed individual in what really was a civil issue - he could have sued - was lawful.

I would like to have a transcript of the Judge's instructions to the jury.

In the OJ case the families of the victims sued; I hope the young women murdered has family who take the killer to court and receive all of his assets in a civil judgment.

Doesn't that strike you as a ridiculous loophole to get around double jeopardy? I, like so many others, tended to think OJ was guilty....but once the criminal trial ended, I was very upset with the subsequent civil trial based on the same acts, but with a less strenuous requirement for a guilty verdict.
