You don't get the distinction? I quoted the same article second paragraph. These people are not getting sued for negligence or violent acts. They are getting sued for violating someone's rights. It's a weaker argument in front of a jury but apparently the judge thinks the complaint has merit under civil law. There's good chance it will be settled out of court unless the Kyle fans want to buy him a bunch of trial lawyers.
