What rights were violated? What an idiot!!
There is no First Amendment protect from public blowback or outcry. There is no first Amendment protection from being fired from a private entity. Even a public entity has the right to set dress codes.
It's called free enterprise and Capitalism, Idiot. A very conservative idea.
Correct.
Moreover, the New York City Taxi and Limousine Commissions decision to suspend the driver in no way violates the First Amendment, as the driver remains at liberty to display his armband in public when not driving, affording Diaz ample alternative channels for communication of his hate and ignorance. And the regulation is narrowly tailored to accommodate a legitimate governmental interest, not seeking to control or limit the content of speech (Ward v. Rock Against Racism (1989)).
Diaz also agreed to abide by the rules of the Commission as a condition of obtaining his license to drive a cab in New York City, where he knew the consequences of violating the rules of the Commission.
