Prosecutors and police have too much power in the criminal justice system. If they charge you with a crime, it doesn't matter if you're guilty, you have to take the plea bargain to avoid the expense of trial and the possibility of a long prison sentence.

Public defenders won't help you. They are overworked and not very motivated.

A private attorney will help you, but only the wealthy can afford to pay.

Most of the time, the process is the punishment.

I disagree.

It costs money and time to defend yourself from fraudulent charges. Copping to a plea can be a very prudent move.

The Trump Organization was fraudulently accused of racial discrimination in the 1970's. It was undoubtably the smart move to cop a plea, pay a bullshit fine, but don't admit anything. It would have cost a lot more to defend against the lies.

President Trump disagreed with the move, but the tremendous Fred Trump was spot on correct in going with the deal

It's a rigged game and all but the most naïve know it.

You can't be convicted without evidence. Prosecutors will make a case, you defend your case, the judge will decide.

The only time it makes sense to take a plea if is there is evidence to convict you.

The system isn't perfect ... sometimes it convicts an innocent. Much more often it lets a guilty man walk free.

But, there isn't an imperfect system that involved humans.

You must have years and years of experience to back that all up. Or, perhaps some links to cases, briefs, studies to shed some light on your assertion.

There is a method to the madness.

Charges are often dismissed by a judge for lack of sufficient evidence ... nolle prosequi.

By adding the related sub-charges to the indictment, it increases the chance of a conviction.

For example, if you commit a burglary and break a window or door, you get charged with burglary and destruction of property. They may not be able to prove you committed a burglary, but they may have sufficient evidence to prove you broke the door or window.

If you get charged with a felony assault, you can also get charged with a misdemeanor assault for the same incident. If there isn't sufficient evidence that you attempted to cause serious bodily harm to an individual with disregard for human life. The evidence may exist that you committed a simple assault.

The judge will hear the police evidence, and he will hear your evidence. Which one is more believable to the judge is totally up to you.
 
And sometimes, it's not about getting a conviction..... a street mutt doesn't care about getting arrested, he only cares about getting convicted, but your average joe?
He will miss work, spend his entire savings on legal fees and bail, maybe lose his job, just the stigma of being arrested will ruin his reputation, and if he really pissed the cops off, they will tell the jailers at county and they will put the guy in a pod with some freaking animals and let him get abused.

You can completely destroy a person's life without him ever being convicted of a single thing.

White people will often have these connections.

Career criminals go down because they're guilty, regular people go down too, because they have no idea how to play the game.
