So, in your theory....the government could have forced the Catholic Church to marry this couple where one was divorced...but guess what, the gvt can't force churches to do anything on this issue...some Churches may choose to marry same sex couples and some or probably most all, would choose not to, and they, (congress) can't write a law that would leave them out of NonProfit organizations, or specifically a law that leaves them out of Not for Profit organizations that get their tax exempt status.
