Current case law maintains that ‘under god’ is Constitutional, that Congress’ intent was secular, and not intended to promote religion.

Of course children can not be compelled to say the pledge, nor may they be punished for wishing to opt out. See:

This can prove problematic for a child, needless to say, as already pointed out. But the suit is likely to fail, unfortunately.

I read a story in the paper where a young girl had to go stand out in the hallway so the drones could recite the "amended" (god added in 1954) pledge. Aint that marvelous? :doubt: It was adopted to counter the red scare. Reminds me of Orwellian group think. Take it out.

Like Del said, imagine a 6 year old who didn't want to say the pledge cuz of the word god. You think that's inclusive or divisive? You think there's a chance a teacher who's religious wouldn't give that kid a fair shake?

I can't ever imagine being the one to sue over something like that, but people do have the right to push such issues when they find themselves affected...In principle, these people have a legitimate complaint.

That's what I think, I don't believe in any god and i don't care if the word is there or not. But those who do have a legitimate complaint.

Imagine if the pledge went "under no god, indivisible, with liberty and justice for all."

People would be rioting in the streets, but when the shoe is on the other foot, they don't understand.

Now, if a child refuses to stand for the pledge then I would say that the teacher has a responsibility to work with the child and the childs parents to teach that child the respect for others in the room.

They shouldn't be forced to say or even learn the pledge, but when it is being said they should at least learn the respect to stand quietly.

So the non-believer should be taught to show respect for the believers, but the believers not taught to show respect for the non-believer.

The story in the OP is not about any fringe group, it is the complaint of one family.

If it were my child expressing to me that he didn't want to say" under God", I would not sue anybody, I would downplay it and suggest he say it his own way and leave out the phrase, BUT you all need to realize not every issue is all about you You YOU.

This family has a legitimate legal complaint and despite any of our opinions of their course of action, it is not some evil liberal conspiracy against you and your God (mine too!)...They have every right to pursue the issue.

Niose says, “Everyday these kids go to school and the pledge is recited and declaring that the nation is in fact under God and that marginalizes them.”



But according state law, schools are required to display the American flag and say the Pledge of Allegiance. But saying the pledge is strictly voluntary for students.

“Students have a right to not say it all, the entire pledge,” says Superintendent Stephen Mills. “I would be acting illegally if the kids didn’t say pledge of allegiance.”
