In most cases, the same leftist fanatics are working out of the same offices, supporting the same socislist causes, using the same stationery (still with the ACORN name on it), and breaking all the same laws. But the charter name in some dusty file cabinet in Delaware, now has a different title.

And those leftist fanatics are hoping you will be stupid enough to believe ACORN is "gone"... just because they say so.

If the idiot from Texas wanted to ban funding for the organizations which have a different name than ACORN, then he should have specified them instead of the extinct one.

ACORN sued the United States Government in the United States District Court in Brooklyn over the measure, known as the "Defund ACORN Act," claiming it was a bill of attainder, and therefore unconstitutional. Experts varied on the merit of the case. One argument was that while government funding choices do not generally qualify as bills of attainder, the lack of a non-punitive regulatory purpose for the legislation may give a court "sufficient basis to overcome the presumption of constitutionality." The court issued a preliminary injunction that nullified the act.

In response to an inquiry from a Housing and Urban Development Department lawyer, David Barron, the acting assistant attorney general for the Office of Legal Counsel, wrote a five-page memorandum concluding that the law does not prohibit the government from paying ACORN for services already performed. On December 11, U.S. District Judge Nina Gershon issued a preliminary injunction blocking the government from enforcing its temporary spending ban, a week before it was set to expire. The Government Accountability Office (GAO) opened an investigation of ACORN in December, 2009. In June, 2010, the GAO released a preliminary report stating the investigation has found no sign the group or related organizations mishandled the $40 million in federal money they received from nine federal agencies.

On August 13, 2010 the U.S. Court of Appeals for the Second Circuit reversed Judge Gershon's decision. The appeals court cited a study finding that only 10% of ACORN's funding came from federal sources, and stated, "We doubt that the direct consequences of the appropriations laws temporarily precluding ACORN from federal funds were so disproportionately severe or so inappropriate as to constitute punishment."

Their law suit went bye bye

Even more so given that the bill specifically specifies ACORN.

I provided links in this very thread why that's the case. But do yourself a favor and actually read the Constitution. It may shock you.
