Same-sex couples in Madison County, Ala., can once again obtain marriage licenses, after a Wednesday order from the chief justice of the Alabama Supreme Court briefly halted the issuance of such licenses, reports AL.com, a website for several Alabama newspapers.

Marriage equality advocates rallied outside Huntsville's Madison County courthouse Wednesday after a probate judge announced that he would adhere to the administrative order from the state's top justice, and only issue marriage licenses to opposite-sex couples.

Roy Moore, the stridently antigay chief justice of the state's highest court, on Wednesday issued an order telling county clerks not to issue marriage licenses to same-sex couples, claiming the U.S. Supreme Court's landmark marriage equality ruling from June did not apply to Alabama.

But by Thursday morning, AL.com reports, Madison County Probate Judge Tommy Ragland had resumed issuing marriage licenses "to everyone." Huntsville TV station WAFF reports that one same-sex couple received a marriage license Thursday morning.

If passed, it would trump the Massachusetts ruling as well as any other such ruling by a court. Note: This is not intended to disparage Christian’s or all religious people who hold different values that myself. It is, however, intended to shine a light on those who would use their religion as a weapon to marginalize and disenfranchise others.

Ask anyone what they think happened in Salem Mass. In 1692 and they are likely to say something to the effect that some unsophisticated settlers, given to religious fervor and superstition during a harsh winter and desolate conditions, became obsessed with evil and targeted those who they saw as a threat. Ask those same people if such a thing could happen today, and they are likely to say “of course not!”

However, I submit to you that it is in fact happening again, only this time gays-not witches are the target. Consider:

In Salem witches were viewed as being possessed by evil that must be exorcised. The religious right of today see gays has being sick and in need of a cure.

The members of the Bay Colony saw witches as a threat to their Christian beliefs and even a threat to the continued existence of Christianity. Today, the religious right speaks passionately about their religious freedom being violated by gay rights and the criminalization of Christianity.

The settlers were driven by ignorance and fear of the unknown, and the need for a scapegoat to blame their problems on witches-which included a small pox outbreak and the perception of religious persecution. Today, we can see these same forces at work among the virulently religious right who have blamed gays for everything from natural disasters, and disease to the risen of liberal secularism.

Yes, the colonists were beset by real and present dangers- Native American’s , pirates, economic difficulties and political tensions with England which added to the stress which in turn contributed to the hysteria and the need to blame someone. We see the same dynamic playing out today with the fear of Islam and ISIS, uncertainty about the economy and the fact that there are people in power who do not reflect their values.

The settlers were so threatened by those who they deemed witches that they imprisoned and murdered them. Today, most on the right do not advocate imprisonment, burning at the stake, or drowning. However, there are those who do lament the decriminalization of homosexuality and some who have in fact advocated the imprisonment and execution of gays.

As in 1692, there is an identifiable triggering condition now. Then, it was a difficult winter living in isolation. Now, it is the rapid rise of the acceptance of gay people, and the speed at which they have gained legal rights culminating in marriage equality

Sprigg urged activists to separate sexual attraction, sexual behavior, and a person’s self-identification and instead to focus on gay relationships, which he called “objectively harmful to the people who engage in it and to society at large.”

Also arguing for an uncompromising stance and “zero affirmation of the gay rights paradigm” was Americans For Truth About Homosexuality’s Peter LaBarbera, who urged anti-gay activists to stop playing defense and go on the offense, reclaiming the moral high ground by always opposing homosexual behavior. One way to go on offense, he said, would be by proposing state bans on hormone therapy and surgery for transgender youth. Other notable anti-gay activists who addressed the gathering included Liberty Counsel’s Mat Staver (via video) and Brian Camenker of MassResistance.

They purport to speak for the entire Christian faith, but in reality, represent a small, paranoid and reactionary fringe.

It is also disturbing to realize the depth of the divisiveness that has developed between these progressive rights organizations and a certain segment of the Christian community, a divisiveness that really does not need to be. The claims that the advance of gay rights and secularism an affront to Christians and impinges on religious freedom is without merit. While there are those that actually believe that is the case, others are knowingly promoting a false idea of religious liberty for their own purposes.

And let’s not forget the American evangelical, including some politicians who have traveled to Africa and Russia to promote those countries antigay agendas, which have included proposals to jail and even execute gays. Even right here in the U. S., in California to be exact, a ballot initiative to allow for the summary execution of gays was proposed.

A Future History Lesson by The Progressive Patriot 5.7.14

While people continue to wring their hands and agonize over same sex marriage, I thought that I would offer some thoughts about what might lie ahead and what we might do to smooth the way. We must realize that down the road anything can happen. Any number of issues, foreseen or not can arise. I frequently rail against slippery slope predictions-such as plural marriage- that are injected into the same sex marriage debate. However, I do so not because I dismiss the possibility that a redefinition of marriage now, can lead to other changes later. Nor am I voicing a moral objection. Rather, I believe that we must deal with further change at the right time, learn from history, and be smarter going forward in order to avoid, or at least minimize the anguish that has plagued the gay marriage debate. I believe that we first have to deal with marriage equality in the here and now and new issues as they arise, spontaneously, in the future. Here is a time line of how it might all play out:

2015: While the debate over same sex marriage continues and more states allow it, intersexual people, those who are not clearly male or female are revealing themselves and begin to assert their rights. In a state that does not recognize same sex marriage, a couple applies for a marriage license. One of them, who wants to marry a male, has the biological and chromosomal characteristic of both a male and a female. This person has an androgynous name and appearance and refuses to identify as male or female. In fact many government forms that ask for “gender” have an option for “other” which this person chooses. The license request is rejected on the basis of marriage still being between a man and a woman.

2015: Later that year, SCOTUS has ruled that same sex people have the same right to marry as heterosexuals as they are now a protected class as well as deserving of equal protection under the 14th Amendment. States that refuse to legislate it are forced by federal courts to allow it. However, there is still the matter of intersexual people. Is he/she / whatever the same or opposite sex as his/her partner. Where do they fit in? Even now that same sex marriage is legal, with the court having found that discrimination against same sex couples is unconstitutional, intersexual people may fall between the cracks. They may not be exactly the same sex, nor the opposite sex of their partner. It’s a gray area, and many jurisdictions are unsure of how to deal with it. Furthermore, while gays and same sex marriage is generally accepted, inter-sexuals are regarded as freaks and are being denied other rights as well.

To further complicate the situation. Non binary, gender fluid people who refuse to identify as either male or female are beginning to assert themselves.

2020: The concept of polyamory-or group marriage, which has been around a while, is gaining in popularity. A heterosexual couple applies for a marriage license to marry another heterosexual couple. At the same time, another couple consisting of a man and a bi sexual woman seek to marry another bi sexual woman. Both applications are rejected and a long and arduous national debate and many court cases ensues. Meanwhile the issue concerning that intersexual situation rages on with some states refusing to be more inclusive.
2025: Inter-sexual people have become rather vocal and militant in demanding rights. More and more of them are choosing to live openly rather than in the closet- pretending to be exclusively male or female. Some, including gays, are accusing them of being bullies in demanding the same rights as “normal’ people, i.e. male or female. As a result of the relentless pushing of the intersexual agenda, some states are changing their laws to include them while others are seeking to ban marriages that include any person who is not clearly male or female. There are also a number of lawsuits pending in state and federal courts.

2030: Group marriage among heterosexuals gains more popular and acceptance, and some states, through legislation or court rulings, are beginning to allow it. Courts find that there is no rational basis for states to deny these marriages. However, all of the cases to date were brought by heterosexual couples who argued that large families of men and women are in keeping with tradition and create the most efficient and efficacious environment for children . They begin to win in court but ruling were narrowly tailored to only include married heterosexual couples or singles marrying other married heterosexual couples or singles. Gays and intersexual people are left out in the cold.

Almost immediately, gay couples are taking notice. They want “equality” –the ability to marry other gay couples and gay singles. More years of debate and legal maneuvering ensue. Rulings go constantly against gay couples. The basis for these rulings is concern for children. While it has been established by this time that gay parenting by a couple does not harm children, studies have emerged-sponsored by the Family Research Council which now supports heterosexual group marriage- that show that a child’s exposure to more than two gay parent figures at a time is in fact harmful, and that is the basis for opposing group marriage for gays. Meanwhile the issue of intersexual people is still unresolved.

2035: The SCOTUS finally decides that marriage is between any two consenting adults solving the problem of what to do about intersexual people. However, group marriage involving gay married couples still is a divisive issue. Furthermore, groups of people-married and single- of different gender, sexual orientation, and gender identity are seeking the right to marry and further complicating the issue.

2040: SCOTUS determines that marriage is a universal natural right and that everyone –including intersexuals haves the right to marry as many people as they wish. There is no rational basis or compelling government reason for restricting marriage at all.
Could the road to 2040 have been less arduous? It would have helped if the issue of same sex marriage as it is before us today was resolved sooner, before other alternative lifestyles came to the fore. Even now, the waters are being muddied by those who bring up plural marriage as an invented issue. It can only get worse if it becomes a real issue before the current debate is laid to rest. I will add, that to push the envelope on issues before their time serves no one’s interest, but we must be prepared to address them at the appropriate time in history and cultural evolution. And in dealing with those future issues, it is important that we build on the lessons that were hopefully learned from the earlier matters. However, that will only happen if we can get over the moronic, puritanical and ridged positions that we hold and think more about what actually makes sense and what’s important and relevant in the current cultural and legal environment.

2045: All is well. The angst of the culture wars is a fading memory. Marital bliss for all. But wait! Farmer Brown in Montana wants to marry his flock of sheep. That same year, space aliens who have been living among us for centuries reveal themselves to us. Young people are fascinated by them and “hooking up” and marrying them becomes a fast moving fad. However, marriage is only for and among humans. The fight begins anew. Pat Robertson literally turns in his grave and Michelle Bachman, now 92, comes out of retirement and teams up with Rick Perry 95 and Rick Santorum 93, to start a clinic to cure people of wanting to have sex with aliens, legal or other wise. At the same time, congressional Republicans introduce a constitutional amendment against (space) alien marriage and adopt a party platform to encourage them to self deport. Intersexuals and Marriage: Another reason why it’s time to get past same sex marriage debate by the Progressive Patriot .6.6.15

While we’re debating the issue of same sex marriage, it has become apparent that most people are not even aware of a related issue: Intersexual people and marriage which is about to turn the current debate about same sex marriage on its head. The fact is that not everyone is clearly a male or female, so the marriage issue is even more complex that most people know. Intersexual people, born with characteristics of both male and female are a reality. So much so that The Intersex Society of North America (ISNA) was founded in 1993. http://www.isna.org/

This condition can range from subtle hormonal and chromosomal “abnormalities” to internal and outward physical signs that the person is not clearly male or female. They may or may not be readily identified at birth, and may not be apparent until puberty. Traditionally, the medical response has been to channel these unusual but real people into being a male or female and to administer early genital surgery as part of that process. As a result according to the ISNA, many people with intersex can’t get legally married, because some doctor decided for them which sex be, which may be contrary to the gender that they feel they are a condition known as gender dysphoria. Another problem is that we, and the medical community have a poor understanding of the consequences of this approach. There may be implications related to trans-sexuality, gender confusion, mental health issues, as well as same sex attractions.

While the ISNA ‘s position is that intersex children should be raised as male or female as has traditionally been the case, they and others have departed from the “concealment centered approach” which is based on hiding and “correcting” the condition as soon as possible , to a client centered approach in which these children are not surgically altered until such time that they are able to provide informed consent. As a result, there is a growing number of children coming of age who choose not to identify as male or female. In other words there is a growing community of intersexual people who reject the societal insistence that they identify as either male or female.

Now before I go on, it’s important that I say that I am in no way claiming that being gay or transgender can or should be explained in purely biological terms. LGBT people should be afforded all of the rights and respect of “straight” people regardless of biology. The point is only that SOME same sex attractions and transgender and transsexual issues MAY be related to intersexual issues. There is so much that we don’t understand.

So, that brings us back to the marriage issue and who can marry who because, as the intersexual movement grows, this will surly come up. What will happen when an intersexual person, who refused to be pigeon holed into a traditional sexual category, wants to marry a male, or a female or another intersexual person. How will we decide who can and cannot marry? Will a person who is more male than female be able to marry a person who is more female than male while being barred from marrying someone who is a male, or mostly male. Will two people who are equal parts male and female be able to marry each other and if not, who can they marry. What will their birth certificates say, who would decide and should that matter? Another question that will arise is should gender be determined by external appearance, internal organs or by genetics. I have already seen government forms used for various purposes where the gender box reads male/female/other….Is that adequate or will it need to be broken down further? These are all questions that we will be struggling with down the road, unless we just stop asking them, stop worrying about what someone is sexually.

Even those intersexual people who choose to live as male or female may face problems when it comes to marriage: In Texas, Sabrina Hill was born a hermaphrodite but now lives as, and is legally a woman. However, her original birth certificate says she's a male. And because of a court ruling in Bexar County, that's all she needs to marry another woman. (However) El Paso County Attorney Jo Anne Bernal had asked the Texas attorney general for an opinion on whether to marry Hill and Tee in El Paso. The County Attorney's Office says they'll still want that opinion for future reference.

These are all questions that we will be struggling with down the road, unless we just stop asking them, stop worrying about what someone is sexually.

Even those intersexual people who choose to live as male or female may face problems when it comes to marriage: In Texas, Sabrina Hill was born a hermaphrodite but now lives as, and is legally a woman. However, her original birth certificate says she's a male. And because of a court ruling in Bexar County, that's all she needs to marry another woman. (However) El Paso County Attorney Jo Anne Bernal had asked the Texas attorney general for an opinion on whether to marry Hill and Tee in El Paso. The County Attorney's Office says they'll still want that opinion for future reference.

(However) El Paso County Attorney Jo Anne Bernal had asked the Texas attorney general for an opinion on whether to marry Hill and Tee in El Paso. The County Attorney's Office says they'll still want that opinion for future reference.

First of all, gays CAN and DO have children, ALL THE TIME. Hetero couples sometimes use the same techniques to have children as gay people do.

While we’re debating the issue of same sex marriage, it has become apparent that most people are not even aware of a related issue: Intersexual people and marriage which is about to turn the current debate about same sex marriage on its head. The fact is that not everyone is clearly a male or female, so the marriage issue is even more complex that most people know. Intersexual people, born with characteristics of both male and female are a reality. So much so that The Intersex Society of North America (ISNA) was founded in 1993. http://www.isna.org/

This condition can range from subtle hormonal and chromosomal “abnormalities” to internal and outward physical signs that the person is not clearly male or female. They may or may not be readily identified at birth, and may not be apparent until puberty. Traditionally, the medical response has been to channel these unusual but real people into being a male or female and to administer early genital surgery as part of that process. As a result according to the ISNA, many people with intersex can’t get legally married, because some doctor decided for them which sex be, which may be contrary to the gender that they feel they are a condition known as gender dysphoria. Another problem is that we, and the medical community have a poor understanding of the consequences of this approach. There may be implications related to trans-sexuality, gender confusion, mental health issues, as well as same sex attractions.

While the ISNA ‘s position is that intersex children should be raised as male or female as has traditionally been the case, they and others have departed from the “concealment centered approach” which is based on hiding and “correcting” the condition as soon as possible , to a client centered approach in which these children are not surgically altered until such time that they are able to provide informed consent. As a result, there is a growing number of children coming of age who choose not to identify as male or female. In other words there is a growing community of intersexual people who reject the societal insistence that they identify as either male or female.

Now before I go on, it’s important that I say that I am in no way claiming that being gay or transgender can or should be explained in purely biological terms. LGBT people should be afforded all of the rights and respect of “straight” people regardless of biology. The point is only that SOME same sex attractions and transgender and transsexual issues MAY be related to intersexual issues. There is so much that we don’t understand.

So, that brings us back to the marriage issue and who can marry who because, as the intersexual movement grows, this will surly come up. What will happen when an intersexual person, who refused to be pigeon holed into a traditional sexual category, wants to marry a male, or a female or another intersexual person. How will we decide who can and cannot marry?
