That all went down the toilet during and after the civil war...Our government has a role to solve problems as they come up. Lots of problems have come up since the founders started this country. They didn't have it all figured out
When the states established their union, the created the federal government and gave it a very limited set of powers. You can find these powers listed in article I, section 8. As you can see, the states never delegated to congress the power to "solve problems as they come up". Congress may only enact legislation that comports with the legislative powers granted to it by the states.
