Trump said Hispanics and Muslims couldn't be a federal judge. What's the big deal?

Mr. Trump is attacking Judge Curiel in a personal business case, not a political one, and as a candidate for President we think he should be above this kind of pettiness. His implied threat against the judge if he becomes President is more obnoxious, though we doubt he could do much about it in office. The political blowback would rightly be enormous.

What elevates Mr. Trump’s remarks to the reprehensible is his equation of ethnicity with bias. That truly is an attack on the independence of the judiciary because it means that a judge can be disqualified from a case merely for his personal background, rather than for any material conflict of interest.

The suit against Trump University is a classic civil fraud case that has nothing to do with ethnicity. Judge Curiel happens to be an American born in Indiana to immigrant parents, but that is of no legal import. He shouldn’t be judged by the ancestry of his parents any more than Chief Justice Roberts should be barred from ruling on religious liberty cases like the Little Sisters of the Poor because he is a Roman Catholic.

As a legal matter this is well established, notably in a 1998 case (MacDraw v. CIT ) in the Second Circuit Court of Appeals. A litigant challenged the fairness of Judge Denny Chin due to his ethnicity. Judge Chin responded by slapping down the complaint and sanctioning the lawyers, and he was backed by the appellate judges. “Courts have repeatedly held that matters such as race or ethnicity are improper bases for challenging a judge’s impartiality,” wrote Judge Ralph Winter, a highly regarded conservative appointed by Ronald Reagan.

Apart from his racist implications, Mr. Trump is also indulging in the left’s habit of attributing the motivations of everyone and everything to race, class, gender and sexual orientation. Claiming that a person’s judgment is determined by his objective circumstances is a Marxist trope. Isn’t Mr. Trump supposed to be running against such thinking?

Trump and the ‘Mexican’ Judge
That's not true. Republicans aren't just racists. They are greedy first.

Trump is a demagogue.

This is what demagogues do.
True and that's the last thing the Republic needs right now, unfortunately in our moral relativism, reality TV, celebrity obsessed culture demagogues are about all we're likely to get, it's sad.

"Let me have men about me that are fat, Sleek-headed men, and such as sleep a-nights.Yond Cassius has a lean and hungry look. He thinks too much. Such men are dangerous." -- William Shakespeare, Julius Caesar

Why can't a liberal Mexican decide a case against a fraudulent university?
He has a conflict of interest, douche bag.
Which is? That's he was born in Indiana? Perhaps we should see his birth certificate.

You mean like the original birther, Obama? Wow, what a stupid lie he told when he said he was born in Kenya. That's probably why he didn't want to show is birth certificate. It proved he lied

Birther light, peddling his lie about Obama again. What would make Kaz lie about President Obama I wonder?
From my understanding Obama never wrote that he was born in Kenya in his book, however it did appear on a promotional pamphlet (not written, approved or even seen by Obama himself) which I assume is why so many people seem to think that he claimed that, so it's a case of passing along misinformation.

Exactly, Obama was an American in America, publishers don't just write that their authors were born in random countries and forget to tell the author that, it's preposterous. And the publisher used it for 15 more years ...

The irony that you use your racism to feed your greed. You work to keep blacks poor and subjugated to government so you can cultivate them for votes for free shit. It would be less evil if you just hated blacks

More whites than blacks get government assistance. You idiot.

I don't get it. Republicans have been anti minority for decades. Trump is only saying what the GOP has been saying behind closed doors for decades. Trump truly represents the party. What's the big deal? That's just who the Republicans are. All of us know it. Like I said, we've known it for decades.
Can you blame the guy for being honest?

So when Trump doesn't want a liberal Mexican, all you see is "Mexican." May want to question your assumptions on who's focused on race, Holmes

He gives pro bono legal services to illegal aliens, douche bag.

Is it un-American that the accused should have a right to an attorney?

That is correct, he did not. The publisher has even released a statement reiterating that Obama never said he was born in Kenya. That doesn't matter to blind partisan birthers or birther lights like Kaz.

Is it un-American that the accused should have a right to an attorney?

Is it un-American that the accused has a judge who doesn't have a vested interest in him losing the case?

Yes they are. He donated money to the Clintons.

If you disqualified every judge who disagreed on an issue with someone before him, where would that end?

Ethnicity is not a vested interest.

What a bizarre shitshow the Republican nomination has become.

The courts ruled years ago that ethnicity or race cannot be a conflict.

Trump supporters are engaging in the identity politics they accuse liberals of promoting.

Bullshit. All the evidence indicates the case is being brought for political reasons.

In most cases the judge doesn't know the politics of the defendant. So that obviously isn't true.

Trump said the Judge in the case against him should recuse himself because he is of Mexican heritage and that he would be bias based on his intent to build a wall and oppose illegal Mexican Immigration.

Turns out the Lawyer facing him and the Judge both belong to / are members of La Raza, and everyone knows what La Raza stands for / believes.
-- Judge, law firm bringing Trump U case both tied to La Raza

So despite the ignorant a-holes, to include Paul Ryan, calling him a 'racist' for asking the Judge to recuse himself, it turns out Trump is (potentially) RIGHT to do so....AND OBAMA'S HAND-PICKED SUPREME COURT JUSTICE, SOTOMAYOR, SAID SO:

FLASHBACK: Sotomayor said ethnicity 'will make difference in our judging'...
http://www.nytimes.com/2009/05/15/us/15judge.html?_r=0

"In 2001, Sonia Sotomayor, an appeals court judge, gave a speech declaring that the ethnicity and sex of a judge “may and will make a difference in our judging.”

In admitting this, Sotomayor did not only admit her own ethnic / gender-based bias but declared ethnicity and gender would and does impact ALL judicial decisions.

No matter what you think of Trump personally, his opinion that the judge should recuse himself is based on 'sound' legal opinion by none other that Sotomayor, OBAMA'S USSC Judge.

The case began in 2010. Nor does a judge 'bring' a case.

.

What did I say the other day about how many times we'd have to point this out?

The lawyer group is not the La Raza you're thinking of.
