The clash between gun rights and child welfare began Friday at around 9 p.m., when Moore was at a friend’s house, where he received a text message from his wife telling him police and state workers were at his home.

He called his lawyer and rushed home. The lawyer, Evan Nappen, told the News the “heavy handed” encounter violated the first, second and fourth amendments because Moore was simply exercising his free speech rights online, and his gun and privacy rights in his home.

“My client is just a blue collar, hardworking union man who wants to enjoy hunting and the outdoors with his son,” Nappen said Wednesday.

The lawyer pointed out that the controversial photo shows Josh with his finger off the trigger — a sign that he understand firearms safety.

Now you're not thinking. By questioning the parents, they gather evidence to get probable cause for a warrant. Police can question suspects at any time. It's up to the parents to decide how far they wish to cooperate with the police at the time of questioning if they wish to cooperate with them at all. They can confer with a lawyer at any time. The parents actually did the right thing....... but it wasn't any raid!!

Didn't the article say that he believed someone called child welfare? What are they supposed to do? Ignore the call? Someone from child welfare showed up with police (because they can ask for a police presence if they feel it might be necessary. They knocked on the door. The home owner declined to open the safe. He wasn't forced to open it. They left.

No raid. No arrest. No gun confiscation.

Edit to add: But let's not lose sight of the fact that FOX is misrepresenting the facts of what happened in the middle of a debate over gun laws. It was, I believe, purposely meant to ratchet up fear among people who already have unduly irrational fears about widespread gun confiscation. That's not even remotely responsible journalism.

The police "over reached" perhaps, but that is not tantamount to a raid. The police asked for access when they did not have the right to, the man refused and the police left. The man is an attention whore and a cry baby.

To error on the side of child safety is one thing. To overreact to a liberal nut who hates guns is another. And from my understanding it is normal practice for police to escort dfs. Only this time it seems dfs was escorting the police who were escorting liberal hate policies.

Moving along to New York Daily News quoting from the gentleman's posting on the Delaware Open Carry forum we have this information.

Not Fox's. Right from the Dad's post.

Moore, 31, said the confrontation stemmed from an anonymous tipster who saw the photo and phoned a New Jersey Department of Youth and Family Services hotline to report the image of the boy holding the gun.

“They had no warrant, no charges, nothing,” the Penns Grove, N.J. tradesman wrote Sunday on the Delaware Open Carry online forum.

Cops demanded the open his gun safe, but he refused.

“I was told I was being unreasonable and that I was acting suspicious because I wouldn’t open my safe,” Moore said in the web posting. “Told me they were gonna get a search warrant. Told ’em go ahead.”

Moore titled his post to the internet forum, “I stood my ground.”

“They never even saw the picture,” Moore added. “It was all hear say (sic). Just a phone call saying someone saw a pic of a child holding a gun.”
