yeah, but that's not what Roberts' opinion in Jarkesy was about. It was about the SEC levying fines without a jury trial.


And in Bright, the Court did NOT say the EPA could not require monitors on fishing boats, but it did say that Courts will determine if the fees violate the fishermen's rights (ie ability to stay in business)

If fishermen are going to break limits then they should be put out of business. No fines just shut down. Same for polluters. No fines just shut down

It wasn't the fish limits. It was forcing the fishermen to pay up to 20% of their gross to pay for onboard monitors without any law saying the EPA could ..... unless a COURT said the fees were reasonable not the agency.

That's it. No reason to get excited, the thief he kindly spoke. (-:
 
They telegraphed this last week when they kicked the ATF in the nuts for overstepping on bump stocks.

Not on 2A grounds but for the agency making up rules that had the force of law outside of the law congress passed.

This is a huge win for the Republic.
