The "not taxed" part is why they were not counted. Non-citizens pay taxes, thus they are counted and always have been. This is not new.

“Not taxed” was simply a delineator, not the reason. Indians not taxed referred to Indians living on reservations under tribal rule or bands of Indians in unsettled territories. At the time, tribes were considered sovereign and reservations were not part of the U.S.

Nobody said it was either illegal nor unconstitutional. What the SCOTUS said is that the Admin did not give sufficient cause to add the question at this late date and did not justify the drop in response rate that even the Admin admits will occur should the question be added.
