Just how fucked up is California?

As a senior citizen who was born in the Golden State and has lived here for his entire life, I think that I understand the situation.

California has become a very liberal state because the fastest-growing ethnicity is Hispanic.

We are next door to the United States of Mexico, so when the economic situation started to deteriorate in our neighboring country, it was only natural that many Mexican people came here for a better life. Then violence broke out in Central America, so many Central Americans came here (especially people from El Salvador) for safety.

Like it or not, they have transformed our state from a conservative state to a liberal state.

Politicians realize that if they want to keep their jobs, they must vote in laws that are immigrant-friendly (such as making California a sanctuary state).

And, of course, Hollywood (aka "the entertainment industry") has always been liberal, so many of them are delighted with this sea change.

*****

Some years back, a Hispanic American leader was very frank. He told people something like this: If you do not like the changes in California, then leave.

Some people ARE leaving, but many more are still coming here.

For one reason the weather here in Southern California is FANTASTIC. Most days really are sunny. I cannot imagine how people can live with snow, excessive rain, tornadoes, etc.!

*****

Like many other posters, I am also disappointed that the killer did not receive more punishment for what he did. But some impartial observers believe that the jury followed the law in making its decision. I do not know enough about the case to comment. I WILL say, however, that every day people are brutalized by perpetrators of almost every ethnicity, and those perpetrators are often given only a slap on the wrist. The liberals, to their credit, control the legislature here in California, so they can do what they want.

The illegal alien that killed Kate got a sentence of "Time Served" for the weapons charges he was convicted of.
Not only that but his new lawyer for the federal case he faces says a vote for a guilty verdict in the federal case is a vote for Trump.

That is how out to lunch California is...
What sentence did you expect for a weapons charge?

Maybe Manslaughter at the bare minimum? Firing a loaded Gun off in a public tourist spot in the daytime should be against the law. You might hit a seagull?
He wasn't convicted of manslaughter

The prosecution overplayed their hand to pander to rightwing (Trump) outrage

They lost
Correct.

And the reprehensible right will continue to try to exploit the woman’s death for some perceived partisan ‘advantage’ – this idiotic thread is proof of that.

Most on the right care nothing about justice or the law, they seek only to propagate their fear, hate, and bigotry.
shut the fuck up jones.....useless piece of shit....care to defend yourself or is this a drive-by post?...

he was guilty of negligent homicide. If you had done it you would have been convicted. Why aren't illegal aliens responsible for their criminal acts in California?
If the prosecution had charged him with negligent homicide (manslaughter) they may have gotten a conviction

But the conservative media never would have tolerated a charge of negligent homicide......so they got a second degree murder charge

and lost

you don't understand our court system. the jury could have found him guilty of the lesser charge of negligent homicide, but they were determined to set him free to "show how tolerant" and stupid California is.
They had that option
But the prosecution did not sell that option

The jury made the only verdict they could given the available evidence
The judge gave the only sentence he could based on the charge he was convicted of

But they had every witness they needed.. what else did they need?

.

Some proof of intent

winger: "but officer, I didn't intend to go 90 in a 35 zone" so you have to let me off, right?

Intent means everything when seeking a first or second degree murder charge

Negligent homicide & involuntary manslaughter does not require intent. Just honesty, integrity & common sense on the jury's part.
Exactly

And that is the venue the prosecution should have pursued

Fucked up enough to be country's most populous state with the largest economy.

and middle class working people are leaving in droves. Pretty soon all you will have is Hollywood idiots and illegals.
what about "Welcome To California, do you know who our Governor is?, Maybe u wanna a make a U turn?"

I just heard this on the radio last week, but there are stories out there where some smart ass is hanging signs under the Welcome to California signs. Their signs say "Illegals, homeless and M-13 Gang Members Welcome."

Zarate was eventually tried for second-degree murder. If found guilty of the charges of second-degree murder, being a felon in possession of a firearm, and an enhancement of using a firearm, Zarate could have faced life in prison without the possibility of parole. The jury also had the option of deciding if he was guilty of involuntary manslaughter (where the death occurs without intent but “through the negligent or reckless actions of the defendant”[30].[16][31]
The jury had the option
But the prosecution can't give two theories as to what happend that day.
a. It was intentional
b. It was an accident

The prosecution built its case around option a.
The jury didn't buy it

Irrelevant. As the post states, the jury had the option for involuntary manslaughter. The prosecutor didn't need to make the case for that verdict. It was solely in the hands of the jury.

Yes...they had the option
But the prosecution didn't give them the ammunition they needed to choose manslaughter

It's what you get when you have Sean Hannity directing your prosecution

Again, from my Wiki post:

The jury also had the option of deciding if he was guilty of involuntary manslaughter (where the death occurs without intent but “through the negligent or reckless actions of the defendant”

It was the defense that gave them all they needed to know for manslaughter. It was the defense that made the case it was accidental. What more did the jury need?????

It had nothing to do with the prosecution. It was a bunch of lowlifes that decided to let this killer free simply because he was an illegal.

The prosecutor gave his version of events which focused on an intentional act that would justify second degree murder

The defense gave their version which justified an accident

Prosecutor lost......deservedly so
Blame Fat Donnie

Okay, so they believed the defense, and the defense said that it was accidental which means it was manslaughter.

Those little commies would have let him off the hook even if there was a video of him pointing the gun at Kate and firing.

How would you know? Were you there? Did you see him "find" a loaded gun and it going off by itself which is physically impossible?

Pretty near the worst place on earth except North Korea or Iran.

In this country we listen to juries, not hysterical conservative media
