The statute associated with the ban states quite clearly "at his discretion", and since the language of the statute is the only pertinent element, SCOTUS must rule in his favor.

As to the Paris Agreement, said mayors are certainly within their rights to spend their tax revenues as their laws permit, until ejected from office.
