Correct, he is being charged as a civilian. He's no longer President. He's been charged with crimes (in the J6 case) for crimes while in office. He had to either be impeached or his term expire before he could be charged. Since he left office he can be charged.

Not "two bites at the apple".

#1 Impeachment is a political process, not a criminal one. The Constitution specifically says impeachment is to allow for criminal prosecution.

#2 The 5th Amendment, which is where the concept of double-jeopardy exists, clearly says it's about crimes. See #1, since impeachment isn't a criminal prosecution, double-jeopardy doesn't apply.

Lets try this about Biden to help you get it.

Today he can't be charged since he is president. The sole remedy as president is to be removed from office. Then he can be tried for acts as a civilian.
Say as president Trump murdered a person. Once impeached and convicted, then he can be tried for murder. Trump however committed no crimes at all. Nothing even to be impeached for. They tried that as you must recall.

I am not discussing if Impeach is criminal.
 
He has no role to play. He wasn’t acting as president. He was acting as a candidate.

That makes his claim to immunity especially tenuous.

What evidence? This is legal theory and the only evidence is what he said. His actions were completely legal. The 1st amendment will vindicate him.

He has BOTH. If by some miracle they are able to get around his immunity clause, they would then have to figure how to strip him of his first amendment rights.

Such as Trump can't say "I'll pay anybody out there $1 million to shoot Joe Biden".
