What is unconstitutional about what Trump proposes?

sheesh ....

Carter bans Iranians to the United States unless they opposed the Shiite Islamist regime or had a medical emergency.

Students were deported for visa violations.

THAT'S THE WHOLE STORY ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^

F'n coward RW's. If they're not whining they're lying.

Did he or did he not ban Iranians from entering the USA, why yes, yes he did. Now...was it unconstitutional?

Emphasis on what he proposes...not what a bunch of shriek ears say he proposes.

Trump's ban on Muslim entry to the U.S. would be unconstitutional, experts say: Donald Trump in the news

Do you not bother to read your own links- or just ignore them?

"I believe Trump's unprecedented proposal would violate our Constitution," said Harvard Law Professor Laurence Tribe. "Both the First Amendment's Religion Clauses and the equality dimension of the Due Process Clause of the Fifth Amendment." Tribe, a constitutional law expert, said Trump's proposal also conflicts with the Constitution's general prohibition on religious tests outside of the immigration context. "It would also conflict with the spirit of the No Religious Test Clause of Article VI," Tribe told MSNBC Monday evening. Beyond the law, Tribe said it was also notable that using religious discrimination for immigration would be "impossible to administer" and "stupidly play into the hands of extreme Islamic terrorists:" NBC News

"The only respect in which religion is a legal criterion in immigration choices is that fleeing religious persecution weighs in someone's favor on the question of being granted refugee status," Richard Primus, a constitutional law professor at the University of Michigan law school, told CBS News. "Saying 'no Muslims allowed' or 'no Christians allowed' would not be legal. It would probably be unconstitutional." There are many forms non-U.S. citizens abroad file to seek temporary or permanent immigrant visas, and none require disclosure of religion. Similarly, immigrants who have been legally admitted to the U.S. and are looking to become permanent residents are also not asked about their religion: CBS Ne

not entirely like Adolph Trump wants to do ... look it up.

Was it unconstitutional when President Jimmy Carter banned Iranians from entering the USA during the hostage crisis?

Nothing. Does someone need to explain the difference between religion and nationality to you?

Better study up on which Iranians he banned, smart ass

Carter deported Iranian citizens, as deplorable as that was at the time, he caved to fear just as you are now. Just the same it was based off of nationality and not religion.

Just like nutters are caving to the fear of not allowing guns to those on the no fly lists. Paranoia is running rampant.

Really scary how we will throw our rights away because of irrational fear.

Simply by being on the no fly list is having your rights violated. I'd like to see a lawful reason for someone to be put on the list in the first place, then we can talk about whether they can own guns or not.

Banning persons from a country is very different from banning people solely upon their religion.

Of course there is a precedent for banning immigration based upon religion- the United States used to limit the number of Jews allowed to immigrate to the United States when being persecuted by Germany and other countries in the 1930's through WW2.

It is as legal to ban Muslim immigrants as it was to ban Jewish immigrants.

And entirely as ethical.

It was most likely constitutional.

It's also constitutional to ban Canadian citizens from entering the country.

Neither one of those has much to do with what we are talking about.

To me he proposes a temporary ban against a potential threat, until the government creates a foolproof solution. What's unconstitutional about that?

Define "foolproof solution" and please, don't get it mixed up with "final solution", you stupid, fucking idiot.

Was it unconstitutional when President Jimmy Carter banned Iranians from entering the USA during the hostage crisis?

No.

Banning citizens of a country from entering- whether its from Iran or Cuba or North Korea is perfectly Constitutional

Banning persons based solely upon their religion is not.

Now- can you tell the difference between an Iranian and a Muslim?

Not allowing the purchase of guns for being on the no fly list is unconstitutional. You are denying them the right to purchase a gun without due process. The reason people are it on no fly lists is because they are suspected terrorists. Being a suspect is not criminal.

Well since the far left sees FDR as a hero for locking up Japanese Americans and does not consider that unconstitutional, not sure why they have a problem with what Trump said..

I searched but can't find anything. So enlighten us - where have any leftwingers considered FDR a hero for the internment of Japanese Americans?

Another far left drone defection!

See how this one will support their far left GOD at all costs?

Founding Fathers: You cant discriminate based on Religion!

Scared RW warriors: But but...what if I'm scared

Founding Fathers: Oh, you're scared? Well, to hell with this document then. :slap:

You almost gotta laugh when the left opens up an issue regarding the Constitution since they have been at war with several parts of the Bill of Rights for decades.
